Chap. 175.—An ACT to Authorize the Sureties of James S. Barksdale,
as late Sheriff of Albemarle, to Discharge the Judgment against them
in Favor of the Commonwealth with the Bonds of the Commonwealth.
In force March 14, 1873.
Whereas, a judgment was obtained on the twenty-third day
of March, eighteen hundred and seventy-two, in the circuit
court of the city of Richmond, by the commonwealth of Vir-
ginia, against James S. Barksdale, late sheriff of Albemarle
county, and Benjamin T. Madison, Thomas Ballard, John C.
Maddox, George W. Parrott, James O. Harris, Henry Thomp-
son, Robert D. Burruss, F. A. Mannoni, John Saunders, F. M.
Estes, Nicholas Thompson, John Mannoni, B. R. Eddins, M.
D. Elliott, Michael S. Gleason, William G. Carr and William
H. Wood, his sureties, for the sum of twenty-one thousand two
hundred and seventy-seven dollars and seventy-one cents, with
ten per cent. interest on six thousand nine hundred and sixty-
one dollars and thirty-eight cents, part thereof, from the
eighteenth day of May, eighteen hundred and seventy-one, till
paid, and with eight per cent. interest on fourteen thousand
two hundred and ninety-seven dollars and thirty four cents,
another part part thereof, from the eighteenth day of August,
eighteen hundred and seventy-one, till paid, and with ten per
cent. interest on eighteen dollars and ninety-nine cents, the
residue thereof, from the third day of June, eighteen hundred
and seventy-one, till paid, and three thousand one hundred and
ninety-one dollars and sixty-five cents damages thereon, and
nineteen dollars and sixty-seven cents costs; and whereas, it is
just and equitable for the commonwealth to accept her own
bonds from said sureties in discharge of their lability, which
is for the whole judgment, with the exception of the damages,
three thousand one hundred and ninety-one dollars and sixty-
five cents, from which they have already been relieved, and
shall be cancelled by the auditor and filed away:
1. Be it enacted by the general assembly of Virginia, That
the auditor of public accounts is hereby authorized and directed
to accept from the said sureties coupon bonds of the state of
Virginia with coupons receivable in payment of taxés and pub-
lic dues to the amount of twenty-one thousand two hundred
and seventy-seven dollars and seventy-one cents, with ten per
cent. interest on six thousand nine hundred and sixty-one dol-
lars and thirty-eight cents, part thereof, from the eighteenth
day of May, eighteen hundred and seventy-one, till paid, and
with eight per cent. interest on fourteen thousand two hun-
dred and ninety-seven dollars and thirty-four cents, another
part thereof, from the eighteenth day of August, eighteen hun-
dred and seventy-one, till paid, and with ten per cent. interest
on eighteen dollars and ninety-nine cents, the residue thereof,
from third day of June, eighteen hundred and seventy-one, till
paid, and nineteen dollars and sixty-seven cents, in full satis-
faction of their liability by reason of said judgment, though as
between the commonwealth and the said James S. Barksdale,
the bonds so received shall be credited at their market value at
the time of their delivery.
2. This act shall be in force from its passage.
