Chap. 168.—An ACT to Authorize the County Court of Amherst County
to Declare James River, or the James River and Kanawha Canal, or
any Part of either, a Lawful Fence within the Limits of said County.
Approved March 13, 1873.
1. Be it enacted by the general assembly of Virginia, That
the county court of Amherst county be authorized, upon the
petition of any proprietor or occupant of lands on James river,
or the James River and Kanawha canal, to declare and estab-
lish said river or canal, or any part of either, within the limits
and jurisdiction of said county, a lawful fence, as to any of the
stock named in the eighth section of chapter ninety-nine of the
Code, edition of eighteen hundred and sixty. But notice of
such application must be given by posting such petition on the
front door of the court-house, and at one or more public places
on or near said river or canal, or the part thereof to which said
petition applies, for thirty days, and by publishing the same
weekly for four weeks in a newspaper published in said county,
or the city of Lynchburg. But at or before the trial of said
petition, any person interested may enter himself a defendant
thereto, and said cause shall thereafter proceed as other causes
on the docket of said court.
2. Said court may, upon like petition and notice of any per-
son interested, revoke, annul, modify or change any order
made by it under the provisions of this act; but such order
shall not be made until at least one year from the date of the
original order.
3. This act shall be in force from its passage.
