Chap. 133.—An ACT to Protect Fish in the Clinch River from the Line of
Scott County to the Tazewell County Line.
Approved March 8, 1873.
1. Be it enacted by the general assembly of Virginia, That.
10 person shall hereafter draw or haul any seine, net, gill net,
loating net, drag; kill with any gun, pistol, gig or with powder;
atch in pens, traps, hook, line and tackle, or in any other
nanner, fish in Clinch river, from the line of Scott county to
ihe Tazewell county line, from the first day of April until the
ifteenth day of June in any year.
2. That no person shall at any time build or repair any dam
across the Clinch river from the line of Scott county to the
Tazewell county line, commonly known as fish dams, for the
purpose of putting therein any trap or net to catch fish, either
running up or down said river; nor shall any person put in
sald river any dam or obstructions of any kind so that fish
may be taken therefrom at such dams or obstructions in any
manner.
3. That it shall be the duty of all owners of mill dams, built
across said river within the aforesaid boundary, to construct at
once and put in said mill dams suitable shoots, slopes, sluices
or fish ladders, so that the fish may have free passage up and
down said river, and to keep the same at all times in good
repair.
4. Any person offending against the first section of this act
shall, on conviction thereof, forfeit and pay the sum of five
dollars for each offence, in addition to which penalty the net or
other instrument employed in violating the same shall be for.
feited and sold, the proceeds of the sale to be applied as here-
inafter provided. And any person violating the second section
of this act, or any person failing to comply with the require-
ments of the third section of the same, shall be fined not less
than twenty dollars nor more than fifty dollars.
5. All fines and forfeitures incurred under this act shall,
when collected, be paid to the clerk of the court, and by him
paid over to the county treasurer, who shall credit it as a part
of the school fund of the county embraced in said boundary.
6. This act shall be in force from its passage.
