Chap. 125.—An ACT to Incorporate the Town of Louisa, in Louisa
County.
Approved March 2, 1873.
1. Be it enacted by the general assembly, That the town
of Louisa, in Louisa county, as the same has _hereto-
fore been or may hereafter be laid off in lots, streets and
alleys, shall be and the same is hereby made a town corporate,
by the name of the town of Louisa, and by that name shall
have and exercise the powers conferred on towns by the fifty-
fourth chapter of the Code of eighteen hundred and sixty, so
far as the same is in force, and shallbesubject toand governed
by all laws now in force or which may hereafter pass for the
government of towns containing less than five thousand in-
habitants.
2. The boundaries of the said town shall be as follows: Be-
ginning at an aspen trea inStephen Dunnington’s yard; thence
north fifty-five and one-half degrees east, six chains ninety-one
links to a persimmon tree in David M. Hunter's field; thence
north twenty-five and one-half degrees east, twelve chains fifty-
seven links to a post in Gooch’s fence; thence north fifty-one
and one-half degrees west, thirty-four chains nineteen links to
a large red oak tree in rear of Mrs. Smith's stables; thence
north fifty-four and one-half degrees west, nine chains sixty-
two links to a cherry tree: thence north eighty-six and one-
half degrees west, eight chains forty links to a fence corner;
thence north eighty-two degrees west, one chain sixty-three
links to a fence corner ; thence south nine degrees west, three:
chains two links to a fence corner; thence southseven and one-
half degrees west, twenty-eight chains sixty-one links to a per-
simmon tree; thence south thirty-one and one-half degrees
west, seven chains sixty-five links to a fence corner; thence
south sixty and one-half degrees east, ten chains eleven links
to a fence post; thence south eighty-nine degrees east, twenty-
four chains forty six links tothe beginning. A plat of the said
town as above laid off shall be returned to the clerk’s office of
Louisa county court and recorded upon the record of said
court.
- 8. The officers of said town shall consist of seven trustees,
who shall compose the town council, a majority of whom shall
constitute a quorum for the transaction of business, and the
following persons shall constitute the board of trustees, to wit:
George J. Sumner, Hyman Levy, F. W. Jones, Jesse W. Mel-
ton, Henry W. Murray, Dr. Gulielmus Smith and Samuel H.
Parsons, to hold their offices until their successors are elected
and qualified as hereinafter provided. The board of trustees
, shall have power to pass all by-laws and ordinances for the
government of the said town that may be deemed proper, not
in conflict with the constitution of the state of Virginia or of
the United States; and also to provide for keeping the streets
in order, opening new streets, grading and paving the same
r,- and making other necessary improvements, for which purpose
they may levy such tax as they may deem proper on all the
property in said town not exceeding fifty cents on the hundred
dollars, and on all avocations, professions or business as are
now subject to taxation by the revenue laws of this state.
4. The board of trustees shall, from their own body, elect a
president, who shall preside at all their meetings, and when
they are equally divided shall, in addition to his individual vote,
give the casting vote. Heshall be also mayor of the town,
and shall be vésted with all the powers of a justice of the
peace within the limits of said town, except that no civil war-
rants shall be tried by him.
5. There shall be annually elected on the first Monday in
a November, by the qualified voters of said town, seven trustees
~ and one town sergeant, who shall be a conservator of the
peace, and invested with the full powers of a constable within
the limits of said town, and also have power to arrest all
offenders within one mile of said limits for offences committed
m Within the limits of said town. He shall collect the town taxes,
®8 and may distrain and sell therefor, in like manner as state
taxes and county levies are distrained for, and the said town
council may take such bond from the said sergeant as will in-
sure his accountability for all taxes received by him; previous
to the first election under this act the council of said town
may appoint a sergeant.
6. Should no election from any cause be held on the day
named in this act for the annual election, such election may be
held on any subsequent day that may be fixed on by the coun-
cil, upon giving such notice by the sergeant as shall be pre-
scribed by the council. The first election under this act shall
be held on the first Monday in November, eighteen hundred
and seventy-three.
7. The trustees appointed under this act, and their succes-
sors who may hereafter be elected, shall have power at their
first or any subsequent meeting to elect a secretary to the
council, who shall be ex-officio treasurer of the town, may fix
his salary and require of him such bond as will insure his ac-
countability for all funds that may come into his hands.
8. This act shall be in force from its passage.
