Chap. 114,—An ACT to Authorize the Board of Public Works to Trans-
fer the Junction Valley Turnpike to the Counties Through which it
Passes. .
Approved March 6, 1873.
1. Be it enacted by the general assembly of Virginia, That
the board of public works are hereby authorized and directed
to transfer to the counties of Augusta, Rockbridge and Bote-
tourt all the rights, title and interest of the state in and to the
Junction Valley turnpike.
2. If the said counties through their boards of supervisors
shall, within three months after the passage of this act, accept
the said transfer, the board of public works shall sell or cause
to be sold, on such terms as to them shall seem best, all the
property, real and personal, pertaining to said turnpike, and
shall apply the proceeds thereof to the payment of any just
debt incurred in the repair of said turnpike. If the proceeds
of such sale shall be insufficient to pay the whole of such debt,
the board of public works shall apportion upon equitable prin-
ciples the balance thereof among said counties ; and the boards
of supervisors thereof shall cause to be paid out of the county
treasury the amount of the debt apportioned to said county ;
or, at the option of said board, they shall cause legal tolls to
be collected on such part of said turnpike within their respec-
tive counties as shall be kept in lawful repair, until a sum shall
be realized therefrom sufficient to pay said apportioned debt ;
after which the road shall be turned over to the townships
through which it passes, to be kept in repair as other county
roads.
3. If any of said counties shall fail to accept such transfer
within three months after the passge of this act, the board of
public works shall transfer to such county or counties as shall
accept the same within the time aforesaid, all the rights, title
and interest of the state in and to said turnpike, together with
all the property, real and personal, pertaining to said turnpike,
on condition that such county or counties shall agree to as- C
sume and pay all just debts incurred in the repairs of said “
road. And the supervisors of such county or counties are
hereby directed to sell, on terms deemed best by them, the p
real and personal property pertaining to said turnpike, and M
apply the proceeds to the payment of such debts; and if the t
sum realized therefrom be insufficient to meet such debts, they
shall cause the balance to be paid out of the treasury of such
county or counties respectively; or, at their option, may collect 0
legal tolls on said road until a sum sufficient therefor shall be «
realized; after which the road shall be turned over to the
townships through which it passes, to be kept in repair as
other county roads.
