Chap. 85.—An ACT to Amend an Act passed January 15th, 1867, entitled
an Actto Amend an Act entitled an Act in Regard to Abandoned
Turnpikes.
In force February 18, 1872.
1. Be it enacted by the general assembly, That the act en-
titled “an act to amend an act entitled an act in regard to
abandoned turnpikes,” passed January 15th, eighteen hundred
and sixty seven, be amended and re-enacted so as to read as
follows:
“8 1. That whenever any turnpike company shall have aban-
doned its road, or a part thereof, the county court of a county
in which such road lies may certify the fact to the township
board or boards in which said road, or any part thereof, is
located, who shall take charge of the same, and keep them in
repair in all respects as prescribed in chapter four hundred
and forty-one of the acts of eighteen hundred and sixty-nine
and seventy, entitled an act amending certain sections of chap-
ter fifty-two of the Code of Virginia (1860), so as to make the
provisions of the chapter conform to the constitution: provided,
however, this act shall not apply to any turnpike which may
have heretofore been taken possession of by the county court
of any county, under the laws in force prior to the passage of
this act.”
2. This act shall be in force from its passage.
