Chap. 6.—An ACT to Ratify and make valid the Right of the Staunton
and Parkersburg Turnpike Company to charge tolls on a section of its
road in the County of Augusta, and to Ratify the acts heretofore per-
formed by the Board of Public Works by virtue of said right.

Whereas, on the sixteenth day of March, eighteen hundred
and thirty-eight, the board of public works, by the name and
style of the Staunton and Parkersburg turnpike company, was
authorized and directed to construct a turnpike road from
Staunton to Parkersburg; and whereas, soon after the pas-
sage of said act the board of public works proceeded to con-
struct the said turnpike road, and, as a part of the same, took
possession of a section of the public highway, known as the
“Free Road,” lying between Staunton and Buffalo gap, in the
county of Augusta, and has continued until the present tame
to use and keep up said section of said road, and to collect
tolls upon the same; and whoreas, a doubt has arisen whether
the transfer of said section of the “Free Road” to the Staunton
and Parkersburg turnpike company, after the great lapse of
time, can be shown to have been made strictly in conformity to
law ; and whereas, it is proper that such defect should be cured
by legislation; therefore,
1. Be it enacted by the general assembly of Virginia, That
the right of the Staunton and Parkersburg turnpike company
to so much of the public highway, heretofore known as the
“Free Road,” as lies between Staunton and Buffalo gap, in the
county of Augusta, be, and the same is hereby ratified and
made valid, together with all and several the acts performed
by the board of public works by virtue of said right; and that
said company be and the same is hereby authorized to collect
tolls upon said section of road in like manner as upon other
sections of its turnpike.
2. This act shall be in force from its passage.
