Chap. 59.—An ACT concerning the Glebe Fund of Essex County,
Approved February 2, 1872.
Whereas, in pursuance of an act of the general assembly,
passed the first day of february, eighteen hundred and forty-
four, entitled “an act authorizing the establishment of a poor
house or houses in the county of Essex,” a part of the glebe
fund of said county was invested in the purchase of a farm
called “ Howard Grove” for the purpose aforesaid, and the re-
mainder of said glebe fund, consisting of state and other stocks,
is now held under the control of the trustees, who were clected
in pursuence of the provisions of the said act of the general
assembly; and it being represented to the legislature that it is
desirable and necessary that the said fund so held should be
transferred and placed under the control of the supervisors of
oni eounty, to be, if they deem it advisable, sold or otherwise
disposed of, and the proceeds re-invested and the income there-
from applicd to the support of the poor of said connty, in
accordance with the provisions of the act of the general assem-
bly. approved the eleventh day of July, eighteen Jvmdred and
seventy, entitled “an act prescribing the duties and compensa-
tion of county officers”: therefore,
1. Be it enacted by the general assembly, That the holders
of the bonds, serip, or certificates of state or other stocks, be-
longing to the glebe fund of Fissex county, deliver the sane to
the treasurer of said county, to be by him held subject to the
order and control of the board of supervisors of said county;
and the said treasurer shall be accountable therefor as for all
other moneys received and disbursed by him for the said
county, and that the said board of supervisors allow the said
treasurer for his services such per centum on the income de
rived from the said funds as they may deem reasonable.
2. Be it further enacted, That upon the motion of the attor-
ney for the commonwealth, or the board of supervisors of said
county, the trustees, or other persons now holding the said
glebe fund, or any part thereof, shall, by the county court of
said county, be required (upon ten days’ notice) to settle, be-
fore one of the commissioners of said court, an account of all
their receipts, disbursements and transactions relative to the
said fund; and any balance which may, upon such settlement,
be found due from’either or any of said trustees or holders of
said fund, may and shall be recovered by like motion in said
court upon ten days’ notice to said trustees or other holders of
said funds.
3. Be it further enacted, That the said act, passed on the
first day of February, eighteen hundred and forty-four, entitled
an act authorizing the establishment of a poor house or houses
in the county of Essex, and all other acts in conflict with the
act entitled an act prescribing the duties and compensation of
county officers, approved the eleventh day of July, eighteen
hundred end seventy, be, and the same are hereby, repealed aS
to said county of Essex.
4. This act shall be in foree from the passing thereof.
