Chap. 315,—An ACT to Prevent the Destruction of Partridyes and other
Game in the Commonwealth.

Be it enacted by the general assembly of Virginia, That it
shall not be lawful for any person to hunt or shoot or other
wise cause the destruction of partridges, pheasants or wild tur-
keys in any of the following counties, viz: Rockingham, Rich-
mond, Alexandria, Frederick, Clarke, .Fauquier, Rappahan-
nock, Prince George, Westmoreland, Loudoun, Goochland,
Northampton, York, James City, Orange, Caroline, Louisa,
_ Princess Anne, Madison, or any other county that may so elect
by order of its board of supervisors, from the first day of Feb-
ruary to the first day of October of each year, or of any wood-
cock, from the first day of January to the first day of July of
each year.
2. Itshall not belawful for any person tocatch any of the game
mentioned in the first section of this act in nets, traps or pens
in said counties, for the purpose of selling such game, for the
period of two years next after the passage of this act.
3. No person who is not a resident of this state shall be
allowed to shoot or take with nets or traps for sale in or out of
this state, any of the game mentioned in the first section of
this act in any of the said counties.
4. Anv person violating either sectionof this actshall pay a fine
of ten dollars for each offence, recoverable before a justice of the
peaceof the county in which the offence was comnuttedorin which
the offender may reside; which fine, with the costs, shall be
appropriated to the fund in support of the county poor-house
of the county in which the offence was committed; and if the
offender shall not, on rendition of Judement against him, pay
the amount of the fine and costs, he shall be committed to the
eounty jail for imprisonment therein for a period of not less
than ten nor more than thirty days.
5. Such offender may be arrested by any citizen or citizens
of this commonwealth with or without a warrant, and carried
before a justice of the peace who shall proceed to try the case
asany other coming before him, and shall give judgement
according to the provisions of this act: provided, that the pro-
visions of this act shall not apply to the counties of Franklin,
Lee, Campbell, Pittsylvania and Southampton.
This act shall be in foree from its passage.
