Chap. 3.—An ACT to Amend and Re-enact Section nine of Chapter eighty-
seven of the Code of eighteen hundred and sixty, as amended by act of
April twenty-nine, eighteen hundred and sixty-seven, entitled ‘‘An Act
to amend certain sections of chapter eighty-seven of the Code of
eighteen hundred and sixty, and in relation to the Inspection of
Tobacco,”

1. Be it enacted by the general assembly of Virginia, That
section nine of chapter eighty-seven of the Code of eighteen
hundred and sixty, as amended by act of April twenty-nine,
eighteen hundred and sixty seven, be amended and re-enacted
so as to read as follows:
“8 9. The governor shall annually in the months of August
or September, or as soon thereafter as practicable, appoint one I
inspector of tobacco for each warehouse established by law in {
any county or corporation; and at the same time the owner or —
owners, or & majority of the same in interest, shall appoint one
other inspector for the said warehouse. It shall be the duty
of the owner or owners, or a majority of the same in interest, 4
within thirty days after said appointment, to certify the said y
appointment to the governor of the commonwealth, who shall ?
commission said inspector. But if it shall appear at the time
specified for the appointment aforesaid on the part of the
owners, or at any time thereafter before the governor has com-
missioned the inspector to be designated by them, that they o
prefer and recommend different persons, and are equally divided , :
‘'s0 that there is not a majority in interest in favor of any one g
person, then, and in that event, the governor shall determine °
which of the persons so preferred and recommended shall
receive the commission of inspector on the part of the owners,
and shall commission him accordingly.”
