pike Company, Extend and Enlarge the Limits of said Road, and Au-
thorize the Erection of a Bridge in connection therewith, across Jack-
son River.
Approvec March 18, 1872.
1. Be it enacted by the general assembly of Virginia, That
it shall and may be lawful for William M. Harvey, of the
county of Botetourt, he being the former proprietor of the
turnpike road heretofore known as the Natural Bridge Turn-
pike Company, incorporated under an act passed February
twenty-ninth, eighteen hundred and thirty-six, entitled ‘an act
incorporating the Natural Bridge Turnpike Company,” to
repair and put in tollable order so much of the said road here-
tofore known as the Natural Bridge turnpike as lies between
the Natural Bridge, in the county of Rockbridge, and the
western terminus of said road, near the Clifton Forge: pro
vided, however, he shall first obtain thereto the consent of the
several township boards in the counties of Rockbridge, Bote-
tourt, and Alleghany, as to so much of said road as lies within
their respective townships.
2. And be it further enacted, That it shall and may be law-
ful for the said William M, Harvey to extend and enlarge the
former limits or boundaries of his said road by opening and
constructing a new turnpike road to intersect therewith, com-
mencing at the Natural Bridge and extending to the James
River and Kanawha canal at Gilmore's mill, in the county of
Rockbridge, and also by opening and constructing a new road
from the former western terminus of said Natural Bridge turn-
pike, near the Clifton forge, crossing Jackson's river, to the
Clifton Forge depot, on the Covington and Ohio railroad; pro-
vided, however, that the new additions hereby authorized to be
made shall not be located, either in whole or in part, upon any
existing county road, without the consent of the board of the
township or townships in which such additions are to be made,
which consent the township boards are hereby authorized to
grant; nor shall such additions be located upon the road of
any existing chartered company so as to interfere with its
rights and franchises, without the consent of such company.
3. And be it further enacted, That so soon as the said Wil-
liam M. Harvey shall have repaired and put in tollable order
the aforesaid road, from the Natural Bridge to its former west-
ern terminus, near the Clifton Forge, as herein provided for,
he shall be reinstated with reference thereto, to all the rights
which he formerly possessed under the original act of incorpo-
ration, including the right to erect gates and demand and re-
ceive tolls, and the said road shall be subject to all the provis-
ions of law that were at any time applicable to the said Natural
Bridge Turnpike Company; and whenever the additions to said
road, or either of them, which are authorized by this act, shall
be completed, such addition or additions shall become part
and parcel of the original road, and be consolidated therewith,
and be subject in like manner to all the provisions of law that
were applicable to the said Natural Bridge Turnpike Com-
pany.
4. And be it further enacted, That it shall and may be law-
ful for the said William M. Harvey, in connection with his said
road, and upon the route or line thereof, to erect a toll bridge
across Jackson's river, at or near Clifton Forge depot, to be
governed by existing laws in reference to bridges; and when
such bridge shall have been declared completed as provided
by law, it shall be lawful for the proprietor, his heirs or legal
representatives, to collect the following rates of toll, to wit:
For every person, horse, mule, steer, bullock, and wheel, pass-
ing over said bridge, five cents; for every sheep or hog, three
cents. But so much of this act as has reference to said bridge
shall be subject to alteration or repeal, at the pleasure of the
general assembly.
5. The name of the said road heretofore known as the Natu-
ral Bridge turnpike, is hereby changed, and the said road shall
hereafter be known by the name of the Natural Bridge and
Virginia White Sulphur Springs turnpike.
6. This act shall not be construed as prejudicing any “egal
right which the said Harvey may have, without its passage, to
repair said road and re-establish thereon toll gates.
7. This act shall be in force from its passage.
