Chap. 13.—An ACT to Provide for the Protection of Fish in the Waters
of New River and its Tributaries.
In force December 2%, 1871.
1. Be it enacted by the general assembly of Virginia, That
from and after the passage of this act, it shall not be lawful
for any person or persons to cause the destruction of any fish in
the waters of New river or its tributaries, by reason of the
erection of fish dams, or fish pots, or by the use of any seines,
dip-nets, stir-nets, or set-nets, for the period of five years from
the passage of this act.
2. That any person violating the provisions of this act, shall
pay the sum of ten dollars for each and every such offence, the
same to be recovered before a justice of the peace, with costs,
and appropriated to the fund for the support of the county
poor-house, and in addition, such person or persons shall forfeit
any such seine or net, and any such dam or fish pot shall be
leveled and destroyed under the direction of the justice, at the
cost of the party violating the provisions of this act.
3. This act shall be in force from its passage.
