Chap. 76.—An ACT to Amend and Re-enact Section 8 of Chapter 329 of the
Acts of Assembly, approved 11th July, 1870, entitled an Act to Incor-
porate the Town ot West Point, so as to ‘Sell Real Estate for Behuguent
Taxes.
Approved February 20, 1871.
1. Be it enacted by the general assembly of Virginia, That
section three of chapter three hundred and twenty-nine of
the act approved eleventh July, eighteen hundred and seventy,
entitled an act to incorporate the town of West Point, be
amended and re-enacted so as to read as follows:
‘4 3. The officers of said town shallconsist of one mayor and
five other citizens who shall compose the council of said town,
and a sergeant who shall be elected by the said council, and
who shall hold their offices for two years and until their suc-
cessors are elected or appointed. The said council shall have
power to pass all by-laws and ordinances for the government
of said town that they may deem proper (not in conflict with
the constitution of the state or of the United States), and to
provide for keeping the streets in order and paving the same,
and for other necessary improvements; for which purpose they
may levy such tax as they may deem proper, not exceeding
fifty cents on the hundred dollars; and they may order and
require real estate in the town delinquent for non-payment of
such taxes to be sold by the sergeant at public auction for
such arrears of taxes with interest and costs thereon: pro-
vided, that such sales of real estate shall be subject to state
and county taxes and the surplus from such sales after deduct-
ing all such taxes interest and costs shall be paid over to the
owner or his representative. Such real estate may be re-
deemed according to the law providing for the redemption
of real estate sold for the non-payment of taxes. Atall meet-
ings of the council the mayor shall preside if present.”
2. This act shall be in force from its passage.
