Chap. 195.—An ACT to Turn Over the Southwestern Turnpike Road to the
Counties Through which it Passes.
Approved March 25, 1871.
1. Be it enacted by the general assembly, That the board of
public works be and they are hereby authorized and directed
to transfer all the right, title, and interest of this state, in and
to the Southwestern turnpike, together with all bridges and
other property belonging or appertaining thereto, to the coun-
ties of Botetourt, Roanoke, Montgomery, Pulaski, Wythe, and
Smyth; and it shall be the duty of the board of supervisors of
each of said counties to take charge of so much of said turn-
pike as may lie within their respective counties, and cause the
same to be put and kept in repair as other county roads: pro-
vided, that said counties, through their board of supervisors,
shall assume and pay all the outstanding indebtedness of said
road, to wit: the sum of four hundred and eighty-one dollars,
as of the first day of October, eighteen hundred and seventy,
and any indebtedness which may have accrued since that time;
but said counties shall be entitled to all the tolls and profits of
said road since the said first day of October, eighteen hundred
and seventy; and the board of supervisors in each of said counties
is authorized to erect toll-gates thereon, subject to the limita-
tions of the general turnpike laws; the tolls collected, except
so much as may be required to pay off the existing debt, to be
faithfully applied to keeping the road in good and lawful re-
air. : ,
2. Be it further enacted, That Robert A. Miller, who is
hereby appointed a commissioner for that purpose, do forth-
with proceed to settle up the affairs ot said road with the pre-
sent officers thereof, and ascertain the amount of the indebted-
ness of said road, and to whom ue, and apportion the amount
of said indebtedness ratably among said counties, according to
the number of miles of said road in such county; and said com-
missioner shall be entitled to have and receive for such services,
the sum of five dollars per day for each day actually and neces-
sarily employed in the discharge of his duties under this act,
and five cents per mile for each mile of necessary travel ; which
sum shall be added to the aggregate of the indebtedness of
said road, and apportioned among the several counties as afore-
said, as is provided in this act for the residue of the indebted-
ness of said road. Said commissioner shall, as soon as he shall
have completed his duties under this act, make a report to the
clerk of the county court of each of said counties, showing
what amount of said indebtedness has been assessed against
said county, and to whom tke same is payable; and if, from
any cause, the said Robert A. Miller shall fail to discharge the
duties imposed by this act, then the judge of the county court
of Montgomery county shall, by an order entered of record,
appoint some suitable person to act as sucn commissioner :
provided, that it shall be the duty of the board of supervisors
of each of the counties named in this act, to provide for the
payment of their respective proportions of the indebtedness
of said road.
3. This act shall be in force from its passage.
