Chap. 176.—An ACT for the Relief of Robert J. Echols, Guardian of Lewis
P., Sterling C., and Susan V. London.

Whereas, the real estate of John J. London, deceased, which
lies in the county of Nelson and known as “Soldiers Joy,”
was assessed in the year eighteen hundred and fifty-six at the
sum of fifty-four thousand eighty-three dollars and seventy-five
five cents, upon which assessment taxes have been paid to the
state from the year eighteen hundred and fifty-six to the year
eighteen hundred and seventy, excluding the period during the
war; and upon which assessment a tax will have to be paid
for the year eighteen hundred and seventy; and, whereas the
true value of the said real estate as it is clearly shown by proper
evidence, did not exceed forty-thousand dollars; and that all
over and above that sum was excessive; and consequently the
taxes paid and to be paid, as aforesaid, upon the said excess
beyond the forty thousand dollars, was erroneous and unjust ;
and whereas, Robert J. Echols, guardian for Lewis P., Sterling
C., and Susan V. London, infant children of John J. London,
deceased, has filed his petition praying to be relieved from the
erroneous and excessive assessment, and to have refunded the
excessive taxes already paid; which petition accounts for the
acquiescence in the said assessment, and the delay in asking
for relief by the owners of the land, upon the ground that they
were, during the whole term, infants: now, therefore,
1. Be it enacted by the general assembly, That the auditor of
public accounts be, and he is hereby authorized and directed
to issue his warrant upon the treasury of the state for the sum
of four hundred and seventy dollars and thirty-four cents in
favor of and payable to Robert J: Echols; two-thirds of the
same as guardian for Lewis P., Sterling C., and Susan V. Lon-
don, infant children of John J. London, deceased, and the
other third in right of his wife; that amount being the exces-
sive and unjust tax paid into the treasury of the state upon an
erroneous assessment of the Soldiers Joy tract of land in the
county of Nelson, belonging to his wards as the heirs-at-law
of John J. London, deceased.
2. This act shall be in force from its passage.
