Chap. 89.—An ACT to amend section 5, of chapter 24, of the act of De-
cetnber 19, 1866, relating to the Sonthwestern Virginia Mining, Smelt-
ug and Transportation Company.

Passed April 24, 1867.

1. be it enacted by the general : esetybly of Virginia, That
the fifth section of the act, chanter twenty-tou, passed De-
cember nineteenth, eightean hundred and SIXT Y-H1X, entitied
an act authorizing The Southwestern Virginia Mining, Smelt-
ing and T ranspor tation Company to snsirnet a railroad from
King’ s salt works to a point on the Virginia and Tennessee

Tu Jroad, at or near Dublin, be amended and re-enacted so as
to read as follows:

“$5. The capital stock of said compzny, to be employed
in the construction of said road, shall not exeeed two mil-
lions of dollars, to be divided into shares of fifty dollars each ;
and it shall be lawfal fur any railroad company in the state of
Virginia to subscribe to the stock to be issued for this ry
pose, and to poy such subscriptions in money, iron, rollin
stock, or other railroad material; or to execute bonds there-
for, upon terms to be agreed upon, in each case. by the par-
ties. And it shail also be lawtul for any railroad company in
Virginia to contract with the said Southwestern Virginia
mining, smelting and transportation company, for the 2 trans-
portation of plaster, coal or other minerals of said company
to market for a share of the proceeds or proiits to be derived
from the sale of such products, upon terms to be agreed upon
between the parties, and without being in any manner held
accguntable, as partner or otherwise, except to the extent
and.in the manner provided in such contract. Dooks of sub-
scription may he opened, under the superintendence of satd
company, at such places as it may determine.”
