Chap. 76.—An ACT to amend the 18th section of the 76th chapter of
Code of Virginia, edition of 1873, in reference to sales of property
of religious, beneyolent and literary associations.

1. Be it enacted by the general assembly, That the thirteenth
section of chapter seventy-six of the Code of Virginia (edition
of eighteen hundred and seventy-three) be amended and re-
enacted so as to read as follows:
§ 15. Whenever any religious congregation, benevolent or
literary association, for whose use a conveyance, devise or dedi-
cation of land has.been lawfully made, shall deem their interest
will be promoted by a sale of such land, or by a morteage
thereof. ov deed of trust thereon, it shall be lawful for any
member of such congregation, benevolent or literary association,
in his name and on behalf of the other members thereof, to
prosecute a suit for either of said purposes in the circuit court
of the connty or corporation in which such land or the greater
part thereof may lie, against the trustees or survivors of them
in whom the legal tithe may be; and it shall be lawful for such
court, if a proper ease be made, and the court be of opinion
that the rights of others will not be violated thereby, to order
the sale of such land or the execution of such mortgage or
deed of trust, and make such disposition of the proceeds of
such sale or mortgage as the congregation, benevolent or lite-
rary association may require.
2. This act shall be in force from its passage.
