CHAP. 69.—An ACT to provide convict Jabor for the Wilson Creck
and South Fork Turnpike Road, between the Mouth of Wilson in
Grayson county and Marion in the county of Smyth,
Approved April 2, 1879.
1. Be it enacted by the general assembly of Virginia, That
the governor be and he is herehy authorized to furnish the
boards of supervisors of Grayson and Smyth counties not less
than twenty-five able-bodied male convicts from the peniten-
tiary to work upon and repair the Wilson’s Creek and South
Fork turnpike road between mouth of Wilson’s creek in Gray-
son county and Marion in Sinyth county. The said convicts
shall be fed, clothea and guarded by the state whilst at work
for said boards at a cost of not more than the cost of main-
taining them in the penitentiary: provided that before the said
convicts are furnished, the said boards of supervisors shall
levy a sufficient amount, apportioned between said counties
according to the distance in each county, to place the said turn-
pike in good repair with the aid of the said convict labor, and
to pay any cost incurred by the state in transporting, feeding,
clothing, guarding and furnishing medical attention for said
convicts: provided further, that nothing in this act contained in
shall be construed to interfere with any existing contracted
regard to convict labor, or with convicts required for the work
shops of the penitentiary.
2. The governor shall have power to annul said contract
whenever in his judgment it shall be expedient for him so to do.
3. This act shall be in force from its passage.
