CHAP. 54.—An ACT to amend and re-enact section 4 of chapter 115
of the Code of 1873 as amended by an act approved March 3lst,
1875, and as further amended by an act approved February Ist,
187 9, relating to mechanics’ liens.
Approved February 10, 1880.
1. Be it enacted by the general assembly, That section four
of chapter one hundred and fifteen of the Code of eighteen
hundred and seventy-three, as amended by an act approved
March thirty-one, eighteen hundred and seventy-five, and as
further amended by an act approved February first, eighteen
hundred and seventy-nine, be amended and re-enacted so as to
read as follows:
§4. A general contractor, wishing to avail himself of the
lien given him by the preceding section, shall file within ninety
days after the completion of the work, in the clerk’s office of the
county or corporation court of the county or corporation in which
the property upon which the lien is sought to be secured is situ-
ated, and in the clerk's office of the chancery court of the city of
Richmond, when the property is in said city, a true account of
the work done or materials furnished, sworn to by said claim-
ant or his agent, with a statement attached signifying his inten-
tion to claim the benefit of said lien, and setting forth a brief
description of the property upon which he claims the lien. It
shall be the duty of the clerk in whose office such account and
statement shall be filed, as hereinbefore provided, to record the
same in a book kept for that purpose, and from the time of
such filing all persons shall be deemed to have notice thereof.
2. This act shall be in force from its passage.
