CHAP. 39.—An ACT to make valid and authorize the re-execution of
a lost lease made by the trustees of the Presbyterian church of
Scottsville.
Approved February 2, 1880.
Whereas John B. Hart, Peter White, Matthew Blair, Joseph
Walker and James M. Garnett, trustees of the Presbyterian
church at Scottsville, Albemarle county, Virginia, by a deed
of lease made on the first day of July, eighteen hundred and
fifty-one, demised to James W. Mason, for a term of sixty
years thence next ensuing, and for a rent reserved of sixty-
five dollars per annum, a part of lot number one hundred and
forty-eight, on the corner of Valley and Bird streets in the
said town of Scottsville, fronting sixty feet on Valley street
and running back fifty-eight feet, it being stipulated in the
said deed of lease that the said Mason, or his assignees, should
have the right to remove all buildings, structures and improve-
ments upon the demised premises at the end of the term, un-
less the said lease should be by mutual consent renewed ; and
whereas the said lease which has been lost was assigned by the
said Mason to C. M. Ragland, and by the said Ragland’s ad-
ministrator to J. S. Moon and James N. Moon, partners as
Moon and Brother, and all the rent which has accrued there-
under has been paid by the parties respectively owning the
lease when such rent became due; and whereas all the afore-
said trustees who executed the said original lease to the said
Mason are dead and some doubt exists as to whether they had
the power to execute the same; therefore,
1. Be it enacted by the general assembly of Virginia, That
the aforesaid lease to the said James W. Mason, upon the
terms and stipulations hereinbefore set forth and recited, be
and the same is hereby confirmed and made valid in every
respect for the benefit of the said Moon and Brother, the
present holders thereof; and that all payments of rent hereto-
fore or hereafter made thereunder are in like manner confirmed
and made valid.
2. That such persons as may now be or may hereafter be-
come the legally constituted trustees of the said Presbyterian
church at Scottsville, or any one or more of such persons, shall
be authorized for and on behalf of the congregation of the
said church, to execute, acknowledge and deliver to the said
Moon and Brother, assignees as aforesaid of the said lost lease,
anew lease of the said demised premises for the unexpired
part of the said term of sixty years, the new lease to be upon
the terms and with the stipulations of the original lease as
hereinbefore set forth; and the said trustees of the said church
now or hereafter appointed, shall have authority for and on
behalf of the said congregation, at or before the expriation of
the said term, to renew the said original lease to the party or
parties then entitled to the benefit of the same for the further
period of sixty years, upon such terms and conditions as may
be agreed upon; and any and all leases and agreements made
in pursuance of this section shall be valid and effectual in all
respects.
3. This act shall be in force from its passage.
