CHAP. 244.—An ACT to amend and re-enact section U0, chapter 101
of the Code of 1873, for the protection of terrapins.

1. Be it enacted by the general assembly of Virginia, That ¢ ¢0, et
the sixtieth section of chapter one hundred and one, Code of anem
eighteen hundred and seventy-three, as amended by an act ap- 3, 1879
proved March third, eighteen hundred and seventy-nine, be
amended and re-enacted so as to read as follows:
§ 60. If any person, after the first day of May and before catch:
the first day of October of any year, shall take terrapins or take "?i"
or disturb terrapin eggs in the waters of the counties of Acco- penne
mac and Northampton, or shall have terrapins in his posses- .
sion, or shall buy or offer them for sale in said counties, he Penal
shall forfeit two hundred dollars and be confined in the county
jail not excecding thirty days. And if any person, after the Takin
first day of May and before the first day of November of any Rayo
year, shall take terrapins with a seine, net or weir in the coun- vemb:
ties aforesaid, he shall forfeit his boats, seines and nets, and Bit
pay a fine of two hundred and fifty dollars and be confined in
the county jail not less than thirty days.

shall, when collected, be paid to the clerk of the vourt, and by how
him paid one-half to the informer and the residue to the county forme

5. The said company shall have power to build branches or
lateral roads, not exceeding twenty miles in length, to connect
with any mines, iron-works or other manufactures, or beds of
deposit of other minerals, in said counties or adjacent coun-
ties.
6. It shall be lawful for said railroad company to borrow
money for the construction or repair of the road, to issue
dDonds and sccure the same by mortgage upon its property or
franchises, or otherwise.
7. It shall be lawful for said company to lease its road or
any part thereof to any railroad company chartered by the
commonwealth.
8. This act shall be in force from its passage.

1. Be it enacted by the general assembly of Virginia, That

proved March third, eighteen hundred and seventy-nine, be
amended and re-enacted so as to read as follows:

8. The officers of said town shall consist of five trustees, who
hall compose the council, four of whom shall constitute a
juorum to transact business, and a sergeant, who shall hold
heir offices for two years and until their successors are elected
ind qualified. The said council shall have power to pass all
yy-laws and ordinances necessary for the proper government of
said town not in conflict with the laws or constitution of the
state or of the United States.
4. The said council shall elect from their own number a pre-
yident, who shall preside at all of the meetings of the council,
and when they are equally divided shall, in addition to his in-
lividual vote, give the casting vote; and he shall be invested
with all the powers of a justice of the peace within the limits
of said town. :
5. Samuel C. Williams, P. W. Pugh, J. W. Basore, Michael
Zigler, and Michael B. E. Cline are hereby appointed trustees
of said town, and shall have and exercise all the powers herein
yranted to said officers, and shall remain in office until their
successors shall be elected and qualified according to law.
6. The said council shall, when organized, and every two
years thereafter, appoint a sergeant, who shall be a conservator
of the peace and have the full power of a constable within the
limits of said town.
7. No license for the manufacture or sale of wine, ardent
spirits or malt liquors within the limits of said town, as pre-
scribed in the second section of this act, shall be granted to
any person, unless such person first obtain from the town coun-
cil of said town a certificate of the council of said town of its
consent to the granting of such license, and the party applying
for such license shall present such certificate to the person or
court having the authority to grant such license.
8. The said council shall have no power to levy or collect a
tax for any purpose whatever.
9. This act shall not be construed as exempting either per-
sons or property in the town of Broadway from service on
roads, or from county or district or road levies, or taxes under
existing laws, or laws that may hereafter be passed, unless
such laws shall exempt the same by name.
