CHAP. 199.—An ACT to amend the charter of the town of Lovetts-
ville, in the county of Loudoun, approved March 26, 1876.
Approved February 25, 1880.
1. Be it enacted by the general assembly of Virginia, That a
the act approved March third, eighteen hundred and seventy- ®
nine, entitled an act to amend and re-enact the act entitled an t
act amending the charter of the town of Lovettsville, in the
county of Loudoun, approved March twenty-sixth, eighteen
hundred and seventy-six, and incorporating into one all acts
amendatory thereof, be amended by adding thereto the following
sections, to come in after section six:
§ 7. The government of said town shall be vested in a mayor a
and a council of six, to be chosen annually by ballot on the }
fourth Thursday of May in each year. Any person entitled e
to vote in the county of Loudoun, and residing within the cor- §
porate limits of the town of Lovettsville six months, shall be #
entitled to vote at all elections under said act of incorporation.
The mayor shall appoint two members of the council, who, Vv
with the recorder of the council, shall hold said election between
the hours of one o’clock post meridian, and they shall decide
any contest in reference to right to vote in any individual. In8
case it is impossible to decide the six who have the largest ©
number of votes, by reason of a tie, the said recorder shall
decide, in the presence of the two councilmen aforesaid, by
lot. The said recorder shall immediatly thereafter make out C
and deliver to each one of the councilmen elected a certificate ©
of his election; and the persons so elected shall enter upon T
their duties on the first day of July next succeeding their elec-
tion, and shall continue in office until their successors are
elected and qualified.
8. The council shall appojnt, annually, a town sergeant T
from the citizens of said corporation; and the council shall R
also elect from their own body a recorder and an assessor. ™
The assessor shall assess all citizens living within the limits of A
this corporation, their real and personal property, and assess 7,
the same according to the best information obtained by him, -
and shall issue tickets for the taxes voted by the council, which Ie
tickets he shall deliver to the sergeant when ordered by the “
council. The treasurer, sergeant and assessor, each, shall give T
a bond of three hundred dollars before the council, payable to *
the corporation and approved by the mayor, before they shall
enter upon their duties. The mayor shall be empowered to x
give judgment and execution against any officer and his surety *
upon his official bond, for neglect of duty, and the sergeant b
shall sell under this execution, as a sheriff sells under an exe- x
cution from court.
§ 9. The council shall elect or appoint, annually, a commis- c
sioner of roads, streets and alleys, and prescribe his duties °
and compensation.
n- - §10. The council shall have power to mark, accurately,
tS bounds of existing streets, to lay off new streets, alleys and
sidewalks; to regulate or prohibit the running at large of ani-
> mals; to provide for order and quiet, and the observance of
the Sabbath within this corporation and one mile beyond its
limits; to provide and protect shade trees; to legislate in
reference to contagious diseases ; pass ordinances to carry into
er effect the object of this incorporation, and to punish the viola-
“I tion of the same by fine or imprisonment, saving to the parties
the right to appeal to the county court in all cases whatever
- wherein the fine shall exceed twenty dollars. Any person vio-
lating the ordinances of said town, and escaping before being
arrested and examined, may be arrested anywhere within the
county of Loudoun, by the sergeant, upon a warrant issued by
the mayor within twelve months from the time the offence was
committed : provided further, that private property for public
use may be taken in the manner now provided for by law for
of that purpose. The mayor’s court of said town shall have the
tt same jurisdiction for the condemning of land for streets, alleys
and sidewalks of said town, as the county court has for con-
demning roads in the county.
§ 11. The mayor shall be the presiding officer of the council,
and he shall have power to suspend any officer of said corpora-
tion, whether elected or appointed, for neglect of duty or dis-
orderly behavior. The council shall have power to remove all
other officers, and may fine members of their own body for dis-
orderly behavior, and, with the concurrence of two-thirds, expel
a member. Any vacancy occurring during the term, shall be
filled by the mayor by appointment; a vacancy in the office of
mayor shall be filled by the council, either from their own body
n or from the electors of said town. The mayor shall have no
vote, except in case of atie; shall have jurisdiction and author-
ity of a justice of the peace of Loudoun county, and may ap-
point two or more policemen annually from among any persons
living within the extended limits of this corporation, who shall
take the same oath the councilmen do. The mayor and coun-
- cil shall define their duty and compensation.
of §12. The jurisdiction of said corporate authorities of said
- town shall extend one mile beyond and outside the limits there-
of for imposing and collecting a license tax upon all shows,
performances and exhibitions which may take place anywhere
within the said extended boundaries; and one person shall be
competent to fill more than one office ; and the councilmen shall
have authority of a justice of the peace within this corpora-
tion, and one mile beyond the limits of said corporation. Three
councilmen shall constitute a quorum.
§ 13. The council may, annually, levy a tax for roads, streets,
*Y or paving sidewalks, and for all other purposes, by a two-thirds
8, vote, approved by the mayor, which, on no property, shall
exceed fifty cents on the hundred dollars’ valuation, except
that, on a petition of two-thirds of the freeholders within the
corporation, the council may levy a corporation tax not to ex-
ceed the amount named in the petition. All petitions shall be
received and referred to the committee on petitions, who shall
report to the council within five days.
§ 14. The council shall regulate the building of all houses,
stables, privies, hog-pens and slaughter-houses, and on a two-
thirds vote of the voters of this corporation, may cause any one
to move any stable; and the mayor and council shall, on com-
plaint, cause all other nuisances to be removed, and no person
shall lay off any sidewalk without permission from the mayor
and council.
§ 15. That any person applying to the county court of Lou-
doun for license to sell wine, ardent spirits, or liquors of any
kind, either as a keeper of an ordinary or eating-house, or as
merchants, within the corporate limits of the town of Lovetts-
ville, in Loudoun county, or within one mile of the limits of the
said corporation, shall produce and present before the court of
said county, a certificate of the council of said town to the effect
that the applicant is a suitable person, and that no good reason
is known to said council why said license should not be granted ;
and the court of said county shall not grant any license to sell
liquors, wines or ardent spirits within the limits above pre-
scribed until and unless such certificate be given.
§ 16. When the mayor is absent, related to or interested in
any offender of the ordinances, then any one of the council
shall be mayor pro tempore, and shall have all the authority
for hearing and determining cases as are vested in the mayor.
The mayor and council elect shall qualify before the mayor
before the first day of July next succeeding their election. The
mayor shall take the oath prescribed by law for all state officers,
and the council shall take’ an oath to faithfully execute the
duties of their office. Ifthe mayor be re-elected, he need not
qualify, hut continue in office.
The council shall meet on the first Monday night of .each
month, or may convene at any time, upon the request or appli-
cation of three members, or by the mayor. There shall be ten
days’ notice of all elections by posting notices at three public
places within the corporation. The election may be held at a
plece designated by the council.
§ 17. To regulate the sale of fire-crackers, fire-works, to regu-
late the exhibition of fire-works, the discharge of fire-arms, the
use of candles and lights in barns, stables br other out-buildings,
and the making of bonfires in streets and yards, to prevent fly-
ing of kites, throwing stones, or engaging in any sport or em-
ploy ment in the public streets or alleys which is dangerous or
annoying, and to prohibit and punish the abusers of animals.
§ 18. To restrain and punish drunkards, vagrants, mendicants
and street beggars.
§19. That it shall be unlawful for any one riding on horse-
back or vehicle, to pass any person or persons, walking or in a
vehicle, or on horseback, going to or returning from religious
worship, within the limits of this corporation, or one mile be-
yond said limits, at a faster speed than an ordinary dog-trot,
where there are no sidewalks; and all persons riding on horse-
back or in vehicles, and all groups of horsemen shall give one-
half of the road on the side on which the footmen are walking,
to two or more footmen, when there are no sidewalks. Any
one so offending, if reported to the officers of this corporation,
shall be fined not less than one nor more than ten dollars for
each offence.
§ 20. That whenever anything for which a state license is
required, is to be done in said town, the council may require a
town license therefor, and may impose a road tax not exceed-
ing twenty cents on each dollar of said state license. The poll
tax shall not exceed fifty cents on each male person in any one
year.
§ 21. That the mayor and council shall have power and
authority to deputize any number of citizens of the town, and
such as may be in town from said county they may think re-
quisite and proper, to assist the sergeant in the full discharge
of his duties in case of riot and all misdemeanors, as he shall
judge necessary.
