CHAP. 160.—An ACT to amend and re-enact section first of the act
to authorize the formation of the New River Railroad Mining and
Manufacturing Company, as amended by acts approved 2d April,
1873, and 15th March, 1875, and to change the name of said company
to the New River Railroad Company.
Approved March 4, 1880.
1. Be it enacted by the general assembly, That section first
of the act entitled an act to amend certain sections of the act
to authorize the formation of the New River Railroad Mining
and Manufacturing company, as amended by acts approved
second April, eighteen hundred and seventy-three, and fifteenth
March, eighteen hundred and seventy-five, and to change the
name of the said company to that of the New River railroad
company, be amended and re-enacted so as to read as follows:
§1. That it shall be lawful for Richard Wood, John J. Cowan,
G. C. Wharton, A. A. Chapman, Elbue Fowler, P. W. Strother,
Jack Carter, S. H. Newberry, C. W. Statham, William Mahone,
J.C. Snidow, William P. Cecil, J. H. A. Smith and Thomas
Graham, any five of whom acting as commissioners, to proceed
to the organization of an incorporated company.to be known
as The New River Railroad Company, which company upon
the formation thereof as heretofore or herein provided, shall
_ have the sole privilege for three miles upon either side of its
adopted line for the period of five years to construct, maintain
and operate a railroad from some point on or near the North
Carolina state line down the valley of New river or any portion
thereof, via New River depot, on the Atlantic, Mississippi and
Ohio railroad to the West Virginia and Virginia state line.
The said New River railroad company shall have the privilege
_ of constructing, maintaining and operating such branch roads
as may be necessary to®bring out coal, iron and other minerals
i and produce from the counties of Giles, Bland, Tazewell, Rus-
| sell, Craig, Montgomery, Floyd, Pulaski, Carroll, Grayson,
Wythe, Smyth, Buchanan, Scott, Wise, Lee and Washington,
and when said company shall locate its main railroad or
branches through any mountain pass or canon occupied by a
county road, or when it is impracticable to make another
road in lieu of the former, the county court may upon motion

Powertoac- permit said railroad to use and occupy said county rvad ; and the
quire lands = New River railroad company shall be further empowered to
acquire ownership of lands, and shall be entitled to enjoy all
the rights and privileges conferred by the laws of Virginia
upon railroad corporations, and shall have perpetual succes-
Proviso sion: provided, that nothing herein contained shall be con:
strued to prevent the crossing of said New River railroad by any,
other railroad, and the said New River railroad shall affor
every facility for so doing. ,
