CHAP. 151.—An ACT authorizing the governor to appoint a special
agent to collect claims due the state of Virginia.
Approved March 3, 1880.
1. Be it enacted by the general assembly of the state of
Virginia, That the yovernor be and is hereby authorized to
appoint a special agent to collect, determine and settle all
claims or debts due the state of Virginia by the United States,
excepting the war claims now in the hands of commissioners
appointed by the legislature. Nothing in this act shall be con-
strued as rescinding any contract made with any agent for the
collection of claims against the United States arising out of
the war with Great Britain, or advances made by the state of
Virginia to the United States.
2. And be it further enacted, That the governor be and is
hereby authorized and directed to contract with the said agent
at a compensation for said services a sum not to exceed twenty-
five per centum upon the net amount of all sums that are
actually collected by said agent and turned into the treasury
of the state of Virginia, and this compensation shall be in full
for his services and expenses in the prosecution and settlement
of all claims that come into his hands for collection. It is the
intent and meaning of this act that said agent shall not claim
anything for his services rendered, or to be rendered, or ex:
penses incurred, or to be incurred, except the commission con-
tingent upon his success: provided, that nothing in this act
shall be construed to Authorize any agent appointed under its
provisions to receive any money due the state of Virginia from
the government of the United States, but any amount ascer-
tained to be so due shall be paid by the authorities of the
government of the United States directly to the treasurer of
the state of Virginia. The treasurer of the state of Virginia
shall, upon the receipt of any amount realized under the pro-
visions of this act, through the agent authorized to be ap-
pointed, pay to such agent the commission agreed to by the
governor under the authority of this act; and it shall be the
(uty of the governor of the state, upon the approval of this
act, to forward a certified copy thereof to the secretary of the
treasury of the United States of America.
3. This act shall take effect from the date of its passage.
