CHAP. 125.—An ACT for the relief of the county of Henrico.
Approved March 3, 1880.
Whereas by an act of the general assembly of Virginia,
approved on the thirteenth day of February, eighteen hundred
and sixty-seven, a large portion of the territory, property and
population of the county of Henrico was detached from the
said county and added to the city of Richmond ; and whereas
before the passage of said act certain debts were contracted by
the county of Henrico in pursuance of law for the purchase of
salt for the use of the inhabitants of the said county as it then
existed; and whereas the said debts have been paid by the
present county of Henrico without contribution from that part
of the said county detached from it and added to the said city ;
and whereas the said debts were not known to exist at the date
of the passage of the said act of February thirteenth, eighteen
hundred and sixty-seven, and no provision was made in the
said act for an apportionment or adjustment of the pre-existing
debts which the said county might be liable to pay after the
year eighteen hundred and sixty-seven; and whereas it is just
and proper that the present county of Henrico should have the
right of contribution against the city of Richmond for such
debts as were contracted before the passage of the said act.
and which the present county of Henrico has been required tc
pay ; therefore,
1. Be it enacted, That the present county of Henrico shall
have a right to contribution against the city of Richmond in
proportion to the amount of taxable property of the said
county taken within the limits of the said city by the said act
for all debts contracted by the said county before the passage
of said act, and which the present county of Henrico may have
been required to pay and has actually paid since its passage,
without having received contribution from the city of Rich-.
mond or that part of the territory of the county of Henrico
taken within the limits of the city of Richmond by the said act.
2. The chancery court of the city of Richmond, upon a bill
filed by the board of supervisors of Henrico county, shall have
jurisdiction to hear and determine all rights of the said county
arising under the provisions of this act, with right of appeal
to either party.
3. This act shall be in force from its passage.
