Chap. 897.—An ACT to amend and re-enact section 3381 of the code of Virginia
in relation to the trial of an issue out of chancery.

1. Be it enacted by the general assembly of Virginia, That section
thirty-three hundred and eighty-one of the code of Virginia, eighteen
hundred and eighty-seven, in relation to the trial of an issue out of
chancery, be amended and re-enacted go as to read as follows:
S35 381. Trial of issue out of chancery.—Any court in whicha chancery
case is pending may direct an issue to be tried in such court, or In any
circuit or corporation court, and the court shall have the discretion to direct
such. an issue to be tried before any proof has been taken by etther the plaintiff
or defendant if tt shall be shown by affidavit or affidavits, after reasonable no-
tice, that the case will be rendered doubtful by the conflicting evidence of the
opposing party,
2. This act shall be in force from its passage.
