Chap. 88.—An ACT to amend and re-enact section 4 of an act approved February
16, 1886, entitled an act to incorporate the Surry, Sussex and Southampton rail-
way Company,
Approved January 22, 1898,
1. Be it enacted by the general assembly of Virginia, That section
four of an act entitled an act to incorporate the Surry, Sussex and
Southampton railway, approved February sixteenth, eighteen® hundred
and eighty-six, be amended and re-enacted so ag to rend | as follows: _.
$4. That it may he lawful for the said company to connect its linc
of “railroad with that of the Atlantic and Danville railway company, or
with the line of any other railway company which may be tapped,
ached or intersected by the line of railroad of the said Surry, Sussex
nd Southampton railway, or any of its branches or extensions by this
ct authorized, upon such terms and conditions as may be agreed upon
yv the said last-mentioned company, and the company owning or con-
rolling the line of railroad so tapped, reached or intersected; and. it
hall likewise be lawful for the said company, by this act created, to
nter into an agreement with the Surry lumber company (a corporation
Xisting under the laws of this state) for the privilege of using and
perating a line of railroad, now operated for lumber purposes, within
he said county of Surry, by the last-named company, in case it shall
e deemed advisable to do so, and the two companies can agree respect-
ng the same.
And it shall likewise be lawful for said company, by this act created,
oO construct and operate in connection with its main line, or with any
f ats branches, any line or hnes of railway that it may desire so to do,
pon rights of wav which have been heretofore, or may hereafter be,
equired by the Surry lumber company, or by any other company or
wersons, by gift, grant or license, on terms mutually agreed upon be-
ween sald railroad company and the company or person owning such
ights of way, but without any power of condemnation; and in the
construction and operation of such line or lines the said railway com-
vany may have the right to cross public highways: provided it shall, in
Joing so, use all the precautions required of railroad companies by the
ceneral laws of this state relative to railway companies for avoiding
langer and inconvenience to travelers along the public highway; and
srovided, further, that the road or roads constructed and operated upon
‘izhts of way thus acquired shall be used only for the purpose of haul-
ne timber and other freights incident thereto, and not im any manner
‘onstructed and used for public purposes as common carriers.
