Chap. 844.—An ACT to incorporate the Rocky Gap and East River Mountain
Top turnpike company.
Approved March 8, 1894.
1. Be it enacted by the general assembly of Virginia, That J. D.
Honaker, Martin Williams, J. H. Bogle, J. C. Carpenter, J. C. Hona-
ker, together with all others who may hereafter subscribe to or be-
come owners of the stock of the company hereby authorized, be,
and they are hereby, constituted a body politic and corporate under
the name and style of the Rocky Gap and East River Mountain Top
turnpike company, with all the rights and privileges and subject to
all the liabilities under the general laws of the state of Virginia
made and provided in reference to joint-stock companies.
2. That the capital stock of said company shall be five thousand
dollars, divided into shares of five dollars each; and J. D. Honaker,
J.C. Carpenter and J. C. Honaker, or either of them, are hereby
appointed commissioners to open books for subscription at such
place or places as they may select. And so soon as one thousand
dollars of the said stock shall have been subscribed, the said com-
pany may organize for business, and the said commissioners may,
on reasonable notice, personally or by publication, to the subscribers,
call a meeting to assemble at Rocky Gap, Virginia, at such time as
such commissioners may indicate in said notice, for the purpose of
organization.
3. The objects of the said company are to re-establish, maintain
aud keep in good order the Raleigh and Grayson turnpike from
Rocky Gap, in Bland county, Virginia, to a point about four miles
west of Rocky Gap, and from said point on the Raleigh and Grayson
turnpike to construct, maintain and keep in good order a new turn-
pike up the south side of East River mountain to the top thereof,
there to connect with a road from the opposite side; and for these
purposes the stockholders may, at their first general meeting, make
such assessments upon themselves as they may deem proper, not
exceeding the amount of their subscription; and thereafter the
directors, who shall not be less than three nor more than five, and
who shall be elected by the stockholders at their first meeting, and
thereafter at such meetings of said stockholders as they may deter-
mine, may make such assessments as they may elect, not exceeding
the aggregate of their stock, and the said directors, unless the stock-
holders should otherwise order, may issue coupon bonds not exceed-
ing ten thousand dollars in amount, secured by deed of trust upon
all or any part of the property of the said company.
4. That the road tax of all the property-holders of Rocky Gap pre-
cinct be collected by the treasurer of the county of Bland, and one-
half of same paid over to said company for the period of five years
from the passage of this act, to be applied to the construction and
improvement of said road.
5. That as soon as the county court of the county of Bland shall
be satisfied from the report of the commissioner of accounts that in
addition to the taxes applied as aforesaid, the sum of two hundred
($200) dollars per mile has been expended by the said company upon
the said road, the said court shall enter the same of record, and the
said company shall be thereupon authorized to erect gates upon the
said road for the collection of toll of all travelers thereon in the man-
ner that shall seem best to said company.
6. That the directors of the said company be,and they are hereby,
authorized to make such arrangements with the property-holders on
said road, or within a mile of the same, on either side or within said
precinct, with reference to toll and payment of the same as they shall
deem best for the company: provided that said property-holders who
are stockholders shall not be taxed with toll until at the rates of the
same their subscription shall have been exhausted.
7. That the property-holders whose road-tax under and by virtue
of this act is applicable to the construction and improvement of the
said road may anticipate the payment of the said tax for the whole
or any portion of the period of five years, and the treasurer shall re-
ceipt and account for the same.
8. That in the event the said company shall issue coupon bonds,
tae coupons of the same shall be made receivable for tolls on said
road.
9. That the treasurer of the company shall give bond in the pen-
alty of one thousand dollars, with security to be approved by the
county court, and shall settle his accounts as to the public moneys
received by him before the commissioners of accounts, who shall re-
turn the same to the county court.
10. This act shall be in force from its passage.
