Chap. 822.—An ACT to authorize the trustees of Emory and Henry college to
sell in lots or parcels certain lands belonging to said college, and to make
such sales subject to such terms, stipulations and conditions as said trustees
may deem proper to impose.
Approved March 8, 1894.
1. Be it enacted by the general assembly of Virginia, That
the trustees of Emory and Henry college shall have, and are hereby
given, power and authority to lay off and sell for the benefit of said
college any parcel or parcels, in lots or parcels of such form and
quantity as they may deem best, of the lands held by them for said
college, whether it be the lands recently purchased by them from
the state of Virginia or previously held and owned by them. And
any such sales shall be made upon such terms and subject to such
stipulations and conditions, as to the use thereof, as said trustees
may deem best for the interest of said college; and any terms, stipu-
lations and conditions plainly stated upon the face of any deed of
conveyance made in pursuance of any such sale or sales shall be
binding, fully and absolutely, upon any purchaser accepting such
deed:
Provided that all purchasers of the lands and lots purchased
by said college from the commonwealth of Virginia so to be sold
are hereby notified that the commonwealth has a lien thereon for
unpaid purchase money, which will be discharged quoad each
particular lot, by the payment to the commonwealth of the purchase
money of the lot or lands so purchased, title to which may be con-
veyed by the college.
2. All sales of any parts or parcels of the said lands heretofore
made by said trustees are hereby ratified and confirmed and made
binding upon the vendors and vendees according to the terms, stipu-
lations and conditions mentioned and contained in any deeds here-
tofore made or hereafter to be made in pursuance of said sales, or
any of them
3. This act shall be in force from its passage.
