Chap. 622.—An ACT to authorize the president of the board of directors of
the Southwestern hospital to release to G. D. H. Killinger and wife, on cer-
tain conditions, any interest held by said asylum on a certain spring on the
lands of said Killinger and wife, in Smyth county.

Whereas G. D. H. Killinger and Margaret Killinger, his wife, exe-
cuted and delivered to the board of supervisors of Smyth county, on
the seventh of July, eighteen hundred and eighty-four, a deed con-
veying the exclusive right to the use of a spring on their land for the
sum of one hundred dollars, the said supervisors purchasing said
right for the purpose of donating and conveying it to the Southwest-
ern hospital, at Marion; and whereas the said board of supervisors
afterwards did convey, as a donation to said Southwestern hospital,
the said spring; and whereas there was a difference of opinion as to
which of two springs was conveyed, or was intended to be conveyed,
by said deeds (the descriptions applying alike to either of two
springs), it appearing from a statement of the chairman of the com-
mittee making the purchase which spring was intended to be sold;
and whereas the said hospital has had no occasion to use said
spring, the said Killinger and wife having conveyed to it a third
and more desirable spring, which is more than ample to supply all
the water that the said hospital is ever likely to need:
1. Be it enacted by the general assembly of Virginia, That the
board of directors of the Southwestern hospital be, and it is hereby,
authorized and directed to execute and deliver to the said Killinger
and wife a deed of release to any and all interest the Southwestern
hospital may have in the spring embraced in the description of the
said deed, nearest the dwelling-house of said Killinger and wife:
provided that said Killinger and wife shall, at same time, execute
and deliver a similar deed of release to the Southwestern hospital
as to any and all interest they may have in the other spring em-
braced in the description of the said deed, dated seventh of July,
eighteen hundred and eighty-four, it being the spring near what is
known as the Preston and Cummings spring.
2. This act shall be in force from its passage.
