Chap. 356.—An ACT to submit tothe qualified voters of the magisterial dis-
tricts of Poquosin and Grafton, in the county of York, the question of a law-
ful fence in said districts. im
Approved February 23, 1894.
1. Be it enacted by the general assembly of Virginia, That upon
a petition of one-fourth of the qualified voters residing in the
magisterial districts of Poquosin and Grafton, in the county of
York, or either of them, presented to the judge of the county
court of that county, he shall order an election to be held in said dis-
tricts, or either of them so petitioning, to decide on the question of
a lawful fence to apply to. the district or districts so petitioning.
The question submitted to be voted on shall be “ for the fence” or
“against the fence.” And if at said election a majority of the votes
cast be “ for the fence,” then a fence four and one-half feet high,
and when built on a mound, it shall include said mound to bottom
of ditch, constructed of material strong enough, and placed so close
together as to prevent such animals as are named in section two
thousand and forty-two of the code of Virginia from creeping
through the same, shall be a lawful fence in and for the limits of
the said magisterial district so voting; and if a majority of the
votes in said district or districts be found at such election to be
“against the fence,” then a Jawful fence in and for such district or
district so voting shall be the same as now prescribed by law for
said county of York.
2. The result of such election shall be certified to the county court
of the said county of York, and entered of record; and the costs of
conducting said election shall be paid by the magisterial district in
which it shall be held, and the same be levied for on such magiste-
rial district by the board of supervisors of said county.
3. If an election be held under the provisions of this act, the re-
sult shall prevent any other election on the same question for the
period of two years.
4. This act shall be in force from its passage.
