Chap. 344.—An ACT for the protection of game in Frederick county.

1. Be it enacted by the general assembly of Virginia, That it shall
be unlawful for ‘any person to kill or capture any deer between the
first day of February and the fifteenth day of September of each
year, or to chase or run any deer with dogs at any time.
2. Or to kill or capture, or offer for sale or buy any partridges or
quails for the space of one year from January first, eighteen hun-
dred and ninety-four, and thereafter, between the first day of Janu-
ary and the first day of November of each year; or any pheasants or
ruffled grouse or wild turkeys between the first day of February and
the first day of November of each year, or any woodcock between
the first day of February and the first day of July of each year.
3. Or at any time to kill or capture any of the species of game
or game birds, herein above enumerated, by trapping or netting, or
at any time to take the eggs of any of said game birds or to inten-
tionally destroy the eggs or nests of the same.
4, Or to kill or capture, or offer for sale any rabbit or hare not
domesticated between the first day of March and the first day of
November of each year.
5. Or at any time to kill or capture any wild turkeys in the man-
ner and mode commonly called “ baiting or blinding,” or to “ bait”
or “blind” wild turkeys with intent to kill the same by lying in
wait in the blind, at or near the baited place.
6. Any person violating any of the provisions of the preceding
sections shall be deemed guilty of a misdemeanor, and shall be fined
not less than ten dollars for the first offence and for each subsequent
offence the fine shall be doubled. Upon conviction one-half of the
fine shall be paid totheinformer. In any prosecution of a person for
the violation of any of the preceding sections, proof of the possession
by any such party of any such game or game birds during the pro-
hibited time shall be prima facie evidence of his guilt.
7. It shall be unlawful at any time for any person to carry, send,
transport or ship, dead or alive, game or game birds of any kind to
any point outside the county in which the same is killed; and any
one violating the provisions of this section shall be fined not less
than ten dollars for the first offence, and for each subsequent offence
the fine shall be doubled; and any person, stage line, railroad or ex-
press company receiving such game or game birds for shipment or
transportation shall be fined not less than fifty dollars. Upon a con-
viction under this section, one-half of the fine shall be paid to the
informer: provided that nothing in this section shall apply to sports-
men who shoot for recreation and pleasure, and who take or carry
away game or game birds, killed by themselves, as baggage.
8. Any magistrate of the city or county wherein the offence is
committed shall have concurrent jurisdiction with the corporation
or county court of all violations of this act.
9. Nothing in this act shall be deemed to interfere with the laws
now in force in regard to the unlawful hunting of birds and other
animals not embraced in this act.
10. This act shall apply only to Frederick county.
11. All acts and parts of acts in conflict with this act are hereby
repealed.
12. This act shall be in force from its passage.
