Chap. 326.—An ACT to authorize the United States to acquire the right of way
for a certain road in the county of Elizabeth City. |
Approved February 21, 1804.
Whereas the United States proposes to expend the sum of two
thousand dollars, or so much thereof as may be necessary, for the
draining and repair of a road from the main road at Gatewood’s
corner to the national cemetery, which said road is about seven
hundred feet in length; and
Whereas the United States requires before any money shall be
expended as aforesaid on the said road, the title to the right of way
shall be granted to the United States free of cost:
1. Be it enacted by the general assembly of Virginia, That the
board of supervisors for the county of Elizabeth City are hereby
empowered and authorized to acquire, by purchase or condemnation,
a right of way not exceeding sixty feet in width, over any and all
property that may lie between Gatewood’s corner on the main road,
in the county of Elizabeth City, to the national cemetery. And if
the said board of supervisors cannot agree with those entitled to the
land upon the terms of purchase for said purpose, they shall apply
to the court of said county of Elizabeth City, which shall appoint
five disinterested freeholders, any three of whom may act, for the
purpose of ascertaining a just compensation for said land; the ap-
pointment of said commissioners, the notice of the application for
their appointment and the subsequent proceedings shall conform to
the provisions of the twenty-sixth chapter of the code of Virginia
of eighteen hundred and eighty-seven, as nearly as may be.
2. That when said right of way has been acquired, the said board
of supervisors are authorized to convey or cause to be conveyed the
same to the United States free of charge.
8. The jurisdiction over the said roadway is hereby ceded to the
United States: provided, however, that the state of Virginia retains
concurrent jurisdiction with the United States over the same, so
that the courts, magistrates and officers of this commonwealth may
take such cognizance, execute such process and discharge such other
legal functions within the same as may not be incompatible with
the consent hereby given.
4, This act shall be in force from its passage.
