Chap. 32.—An ACT to amend and re-enact section 3888, code of Virginia 1887,
entitled “ how attempts to commit offences punished.”
Approved January 15, 1894.
1. Be it enacted by the general assembly of Virginia, That section
iirty-eight hundred and eighty-eight, code of Virginia eighteen hun-
red and eighty-seven, shall be re-enacted so as to read as follows:
§ Section 3888. How attempts to commit offences punished.—Every
erson who attempts to commit an offence, and in such attempt does
ny act towards its commission, shall, when not otherwise provided,
e punished as follows: If the offence attempted be punishable with
path, the person making such attempt shall be confined in the peni-
‘ntiary not less than two, nor more than five years, except attempls
commit rape shall be punishable with death, or in the discretion of the
ry, by confinement in the penitentiary not less than three nor more than
yhteen years; if it be punishable by confinement in the penitentiary
e shall be confined in jail not less than six nor more than twelve
ionths; if it be punishable by confinement in jail or fine, he shall
be confined in jail not exceeding six months, or fined not exceeding
one hundred dollars, but if the attempt be to commit grand or petit
Jarceny, he shall be fined or imprisoned in jail, in the discretion of
the jury, not less than fifteen days, nor more than six months.
2. This act shall be in force from its passage.
