CHAP. 339.—An ACT to amend and re-enact section 4099 of the
code of Virginia, 1887, in reference to how penalty remitted,
when in an action or scire facias on a recognizance, the penalty
is adjudged to be forfeited.

1. Be it enacted by the general assembly of Virginia,
That section four thousand and ninety-nine of the code of
Virginia be amended and re-enacted so as to read as fol-
lows:
§ 4099. How penalty remitted.— When an action or scire
facias on a recognizance the penalty is adjudged to be for-
feited, the court may, on an application of a defendant,
remit the penalty or any part of it, and render judgment
on such terms and conditions as it deems reasonable.
2. This act shall be in force from its passage.
