Chap. 226.—An ACT to create a road board for the county of
Buckingham, and provide for working the roads of said
county.
Approved February 16, 1892. ,
1. Be it enacted by the general assembly of Virginia,
‘That the judge of the county court of the county of Buck-
ingham and the supervisors of the county of Buckingham
constitute a road board for said county; that the said
judge of said county be the president of said road board;
that the clerk of the county court of the said county be
the clerk of said road board; that it shall be the duty of
the said road board to devise such ways and means for the
utting in repair all the public roads of the county of
uckingham at the earliest practicable time, and for the
keeping of the same in repair, as said road board is au-
thorized under this act.
2. It shall he the duty of said clerk of said road board
to keep in a well-bound book a true and accurate account
of all motions, resolutions, enactments, contracts, and
votes of said road board. Said record, as kept by said
clerk of said road board, shall be kept in the county clerk’s
office of the county of Buckingham, and subject at any
time to the inspection of any citizen of said county.
3. It shall be the duty of said president of said road
board of said county, as soon as practicable after the pas-
sage of this act, to convene said road board at the county
seat of said county by a written notice upon each member
of said board, said notice to contain the authority for the
Bame, and signed by the president of said board and
countersigned by the clerk of the same. Said notice must
be posted at least fifteen days previous to the convening
of said board; and it is further provided, that a true copy
of said notice shall be mailed to each post-office in the
county of Buckingham, with request to post the same at
least fifteen days before the convening of said board, as
above specified.
4. Said road board is hereby empowered to let to con-
tract all or any part of the public roads in the county of
Buckingham not exceeding a term of more than ten years
upon such terms and on such conditions as- said board
may deem best and most expedient for the interest of
said county. It is further provided in this act, that any
party or all parties contracting for putting in repair and
keeping in repair all or any part of said public roads of
said county will be hereby required to execute bonds
before the county court of said county, the penalty of
which shall not be less than double the amount of any one
contract entered into with said road board of said county
as heretofore provided in this act; and it is further pro-
vided, that it shall be the duty of the attorney for the
commonwealth of the county of Buckingham to endorse
upon each and every contract before entered into by said
road board with any party or parties, whomsoever it may
be, his opinion that the same is valid and binding. )
5. It is further provided that if said road board of said
county, by or before the first day of July, eighteen hun-
dred and ninety-two, fails to confirm, as above specified,
a contract with any party or parties for the putting in re-
pair and keeping in repair of all the public roads of said
county, said road board shall, as soon as practicable, pur-
chase such kind and such a number of implements as it
deems best for putting in repair and keeping in repair the
public roads of said county, and apportion between the
magisterial districts of said county such implements, and
pay for such implements as said board deems best for said
county.
' 6. It is further provided that all citizens of the county of
Buckingham that are subject to road service under the
general road law of Virginia, unless relieved from such
service by the county court of said county for legal and
sufficient reasons, shall be required to work upon some
public roads in said county sixteen hours in each twelve
months: provided that no resident of said county shall
be required to work upon any public road more than five
miles from his residence. It is further provided by this
act, that if any resident of said county, unless exempt
from such road service as above specified, prefers not to
perform actual service, he is privileged to furnish a sub-
stitute of like ability as himself, or pay one dollar and
fifty cents in lieu of the sixteen hours’ work, or to be cred-
ited ten cents per hour for each hour of actual service. If
such service is not rendered by such parties, as provided
under this ‘act, or such substitute is not actually furnished
for such service, or such penalties are not paid to such offi-
cer or officers as will be hereinafter authorized to collect the
same, it is provided that all real estate, personalty, goods
or chattels that are subject to levy for county or state
taxes, shall be liable to said penalties, as above specified
in this act.
7. Said road board shall then proceed to elect one road
commissioner from each magisterial district in said coun-
ty. Said commissioner must be a resident of the district
in which he is to serve. The commissioners so elected
shall, at the next term of the county court after their
election, qualify before the said county court as any coun-
ty officer, and give bond, the penalty of which shall not
be less than five hundred dollars, for the faithful perform-
-ance of all duties as required under this act, and for the
payment of all money collected by said commissioner un-
der this act to the county treasurer, as hereinafter provi-
ded. The term of office of the commissioner first elected
under this act shall expire July first, eighteen hundred
and ninety-three. All other.terms shall be for two years.
It is further provided that said commissioner shall, at
such times as said road board may direct, summon as
many citizens at one time for road service as said road
board has furnished said commissioner with implements
for the use of same. It is further provided that said com-
missioner shall be empowered to employ such teams as
said road board may deem necessary for the use of said
commissioner in the performance of his duties as -said
commissioner. This must be continued until all residents
liable to road service under this act have been summoned.
Said commissioner must keep an account of all the par-
ties summoned, the time of actual service of each party
summoned, and of all parties summoned who failed to at-
tend, and report to said county board at its next meeting.
Said commissioner shall be liable at any time, for just
cause, to be removed from office by said board.
8. The said county road board, after an examination of
the reports of said district commissioner, shall direct the
clerk of said board to prepare a ticket stating the amount
due by each party summoned, whether it be in full or
part, such ticket to be signed by the president and coun-
tersigned by the clerk of said road board, said tickets to
be delivered to said commissioner, and said commissioner
shall be allowed sixty days to collect said tickets, or re-
port to said board at the next regular meeting of said
board why such, or any part of such, collections were not
made. Said commissioner shall, at the expiration of sixty
days, pay over to the county treasurer any money that he
has collected after deducting five per cent. for collecting
same. The county treasurer of said county shall receipt
to said commissioner for all money received of same,
and place all money collected from each magisterial dis.
trict by said commissioner to the credit of the road fund
of said district.
9. It is further provided, that said road board of said
county, unless otherwise hereinafter provided in this act,
shall have four regular meetings each year. The time of
such meetings shall be decided by said road board. The
president, or four members of said road board, are author-
ized hereby to call a special meeting of said road board at
any time that there may be a riecessity for said meeting.
If all or any part of the public roads in said county should
not be let to contract, said road board shall, after thirty
days’ notice, as provided i in this act, on the second regular
meeting of said road board of each year after the first
year, receive and confirm at their discretion bids for same,
as provided for in this act. It is specially provided that
if said road board confirms at any time a contract with
any party or parties, as provided in this act, for the put-
ting in repair and keeping in repair all of the public roads
of the county of Buckingham, there shall not be more
than two regular meetings of said road board during any
one year thereafter.
10. It is provided that each member and the clerk of
said road board of said county shall be paid three dollars
each day while in actual attendance upon the meetings
of said road board of said county, out of the road funds of
said county upon the presentation to the treasurer of the
county of Buckingham of a warrant of said road board of
said county, signed by the president and countersigned
by the clerk of the said road board of said county: pro-
vided that no member or the clerk of said road board
shall be paid more than twenty-one dollars for any one
twelve months.
11. It is further provided, that said district commis-
sioner hereinbefore provided for in this act shall] receive
two dollars per day for all time actually consumed in
summoning all residents of said county subject to road
service as provided for in this act, and for directing the
services of same as provided for in this act: provided,
that no road commissioner elected under this act shal]
receive more than forty dollars for any one twelve months.
It is provided by this act that the road board of the said
county shall, at the expiration of each twelve months of
the time of service of any road commissioner tbat has
been elected and served under the provisions of this act,
by a majority vote, direct a warrant to be drawn on the
treasurer of the county of Buckingham for the amount
due said district road commissioner, as provided for in
this act. Said warrant shall name the district of the
commissioner in whose favor it is drawn, and shall be
signed by the president of said road board and counter-
signed by the clerk of the same. The treasurer of the
county of Buckingham shall, upon the proper presenta-
tion of said warrant as hereinbefore specified, pay to the
party in whose favor said warrant is drawn out of such
unds not otherwise appropriated, the amount of same.
12. It is further provided that said road board of said
county are hereby empowered by a majority vote of same,
to use road funds of said county, either collectively or
distinctly, in each magisterial district of said county.
13. It is further provided that nothing in this act shal]
be construed to lessen the authority of either the judge of
the county court of said county or the board of super-
visors under the general road law of Virginia in regard to
repairing or building bridges in said county of Bucking-
am.
14. It is further provided that the board of supervisors
of the county of Buckingham are hereby empowered, at
their discretion, to increase the county road levies of the
county of Buckingham to an amount not exceeding the
sum of twenty-five cents per one hundred dollars on all
property within said county subject to road levies.
15. It is further provided that the board of supervisors
of the county of Buckingham, at their discretion, be, and
the same are hereby, empowered to borrow a sum of money
not exceeding five thousand dollars, at a rate of interest
not exceeding six per centum per annum, fora term not
exceeding ten years, bonds to be issued for the same, as
provided for by the existing laws of Virginia. Said
board of supervisors shall annually levy an amount suf-
ficient to pay the annual interest on said bonds as the same
shall fall due, and to provide a sinking fund to meet the
principal when it shall fall due. It is further provided
that any money borrowed by the board of supervisors of
the county of Buckingham under the provisions of this
act, shall be used for building new roads, putting in re-
pair and keeping in repair the existing public roads of
the county of Buckingham, or the building of new bridges,
repairing and keeping in repair the existing bridges of
the county of Buckingham, and for no other purpose.
16. It is further provided that said board of supervisors
of the said county be, and the same are hereby, empowered
to loan all or any part of the saidsum of money above
named to any contractor or contractors of the public roads
of the said county when contracted for as above provided,
at a rate of interest not exceeding six per centum per an-
num, and for a term not more than five years, upon such
terms and conditions as said board of supervisors may
deem safe for the interest of said county.
17. It is further provided that no voting member of said
road board of said county of Buckingham shal] be a con-
tractor for putting in repair, and keeping in repair, or be
the partner of any contractor of, all or a part of any of
the public roads of said county. Said road board shall
declare null and void any contract that has been entered
into for putting in repair and keeping in repair all or any
part of said public roads in said county in which any vot-
ing member of said board may be interested with the con-
tractor.
18. It is further provided that it shall be the duty of
the supervisors of the county of Buckingham to semi-an-
nually, at such times as said road board of said county
may decide upon, to personally pass over and inspect all
of the public roads of their respective districts, and report
in writing to said road board of said county at its subse-
quent meeting. If contractor, or contractors, or district
commissioner, as the case may be, has complied with con-
tract or contracts, or discharged the duties as required
by said road board under the provisions of this act, said
supervisors of said county are to receive such pay for said
service as provided under this section as said road board
of said county may decide upon.
19. It is further provided that said road board of the
county of Buckingham may continue the existing road laws
of the county of Buckingham until July first, eighteen hun-
dred and ninety-two.
20. All acts and parts of acts in conflict with this act
are hereby repealed. .
21. This act shall be in force from its passage.
