Chap. 51.—An ACT to amend the Charter of the Valley Railroad
‘ Company.
Approved February 10, 1876.
1. Be it enacted by the general assembly of Virginia, That
the fourth section of an act passed February twenty-third,
eighteen hundred and sixty-six, entitled an act to incorporate
the Valley railroad company, as amended by an act passed
March thirtisth, eighteen hundred and seventy, entitled an
act amending the charter of the Valley railroad company,
be amended and re-enacted so as to read as fo'lows:
§4. The said Valley’ railroad company shall, at one or
more points within or near the corporate limits of the town
of Lexington, construct one or more depots upon the boun-
dary line of the ground condemned to the use of the North
river navigation company; and shall, at one or more points
within the corporate limits of the town of Pattonsburg, con-
struct one or: more depots on the boundary line of the land
condemned to the use of the James river and Kanawha com-
pany: and shall construct a side line of its road from its
main line to such Pattonsburg depot or depots; and shall de-
liver from the said depots any freight or tonnage intended for
transportation, either on the canal at Lexington or on the
canal at Pattonsburg; and shall receive into the said depots
any merchandise or other freight coming upon either of the
said canals and intended for transportation on the said Val-
ley railroad; and no additional or extra charge shall be made
by the said Valley railroad company for such delivery out of,
or receiving into said depots. .
2. Be it further enacted, That in consideration of the re-
lease of the said company from its original obligation to
establish a depot or depots in. the town of Buchanan, and in
accordance with a contract of adjustment recently made and
entered into between the board of supervisors of Botetourt
county and the Valley railroad company, whereby all mat-
ters of controversy in respect to the subscription by said
county to the stock of said company and the location of said
company’s line of road through said county have been finally
settled, it shall be the duty of said company, upon the com-
pletion of its main-line of road through the county of Bote-
tourt and before the same shall be used for general railroad
purposes, to construct across James river a covered bridge
with its southern terminus within the corporate limits of the
town of Buchanan, to be constructed in the manner pre-
scribed in said contract of adjustment, or, in lieu thereof, to
purchase the existing toll-bridge between Pattonsburg and
Buchanan; and in either case, the title to said bridge shall
be conveyed to and vested in the county of Botetourt, to be
used by its citizens as a free bridge, and by the general pub-
lic under such regulations as the board of supervisors of said
county may prescribe; and it shall further be the duty of
said company, upon the completion of its main line and be-
fore its use as aforesaid, to construct a macadamized turnpike
road from the town of Fincastle to the nearest depot on the
road of said company, to be constructed in the manner ‘pro-
vided for in said contract of adjustment; and the title to said
macadamized road shall be conveyed to and vested in the
county of Botetourt for the uses and purposes hereinbefore
stated in respect to the bridge across James river.
3. This act shall be in force from its passage.
