Chap. 257.—An ACT to amend and re-enact the twenty-sixth section
of chapter ninety-eight, Code of eighteen hundred and seventy-three,
in relation to the manner of making James River and the James River
and Kanawha Canal in Amherst a Lawful Fence so as to include
Nelson.

1. Be it enacted by the general assembly, That section
twenty-six of chapter ninety-eight, Code of Virginia, edition
eighteen hundred and seventy-three, be amended and re-
enacted so as to read as follows:
§ 26. That the county courts of Amherst and Nelson coun-
ties be authorized, upon the petition of any proprietor or
occupant of lands on James river, or the James river and
Kanawha canal, to declare and establish said river or canal,
or any part of either, (the condemnation line of the latter
being construed as part thereof,) within the limits and
jurisdiction of said counties, a lawful fence as to any of the
stock named in the eighth section of this chapter. But
notice of such application must be piven by posting such
petition on the front door of the courthouse, and at one or
more public places on or near said river or canal, or the part,
thereof to which said petition applies, for thirty days, and
by publishing the same for four weeks in a newspaper pub-
lished in either of said counties; as the case may be, or the
city of Lynchburg if the petition relates to Amherst. But
at or before the trial of said petition, any person interested,
may enter himself a defendant thereto, and said cause shall
thereafter proceed as other causes on the dockets of said
courts. :
