with reference to Non-residents Fishing in the Waters of the Com-

~ 1. Be it enacted by the general assembly of Virginia, That
section twenty-three of chapter one hundred, Code of eighteen
hundred and seventy-three, be amended and re-enacted so as
to read as follows:
§ 23, If any person not a resident of this state shall catch
or take fish in any of the waters thereof, in any other way
than by a line held in the hand, or attached to a pole or rod
held in the hand, he shall forfeit not less than twenty-five nor
more than two hundred and fifty dollars, one-half whereof
shall go to the informer: provided, that non-residents who
rent or lease the shores of land owners, and who actually re-
side thereon, shall not be liable to the penalty imposed by
this section. ,
2. This act shall be in force from its passage.
