Chap. 14.—An ACT to amend and re-enact the tenth section of Chap-
ter ninety-nine, Code of Virginia, edition of eighteen hundred and
seventy-three, in relation to Unlawful Hunting.
Approved January 26, 1876.
1. Be it enacted-by the general assembly, That the tenth
section of chapter nine-nine, Code of Virginia, edition of
eighteen hundred and seventy-three, in relation to unlawful
hunting, be amended and re-enacted so as to read as follows:
§ 10. If any person (except from the land) shall shoot at
or kill wild fowl during the night, within this state, or if any
person shall, from a skiff or float, or by the aid thereof, within
the jurisdiction of the counties of Fairfax, Prince William,
Stafford, or Henrico, whether in the night or day-time, shoot
or kill wild fowl, he may be convicted thereof before a jus-
tice, and on conviction, shall surrender his gun and any such
skiff or float, and the same shall be forfeited to the common-
‘wealth. If he fail to surrender them, he shall be committed
to jail for thirty days, unless the surrender be sooner made;
and if any person offending against this section be not an
actual resident of this state, he shall, moreover, forfeit two
hundred dollars; and if any non-resident of this state shall,
in like manner, from a skiff or float, or by the aid thereof, in
the broad waters of Back bay, within the jurisdiction of the
county of Princess Anne, or in any other waters of this
commonwealth, shoot or kill wild fowl, he may be proceeded
against by warrant, and be convicted before any justice hav-
ing jurisdiction, and upon such conviction, shall be fined for
every offence, not less than ten nor more than fifty dollars,
to be recovered as other fines are recoverable by law, to be
collected and paid for the use and benefit of the literary fund.
2. This act shall be in force from its passage.
