Chap. 129.—An ACT to amend an act passed March twenty-ninth,
eighteen Hundred and forty-eight, entitled an act to Establish the
Town of Monterey at the seat of justice for the county of Highland.
Approved March 17, 1876.
1. Be it enacted by the general assembly of Virginia, That
the boundaries of the town of Monterey, in the county of
Highland, incorporated by an act entitled an act to establish
the town of Monterey at the seat of justice for Highland
county, passed on the twenty-ninth day of March, eighteen
hundred and forty-eight, shall be and the same are hereby
extended and enlarged as follows: Beginning at a gate-post
corner of G. W. Fraley’s lot, thence south sixty-four and a
half degrees, east seventy-nine poles to a stone in A. H.
Fleisher’s pasture field; thence south twenty-six degrees,
west twenty-six poles to the Staunton and Parkersburg turn-
pike; thence crossing the same on the same course fifteen
poles to. the south-eastern corner of N. A. Whitlaw’s lot;
thence north sixty-four and a half degrees, west twenty and
a half poles to the corner of W. A. Cunningham’s lot; thence
south twenty-six degrees, west twenty-eight poles to L. H.
Stephenson’s corner; thence with his line north sixty-four
and a half degrees, west ninety-one poles te a point on his
line; thence north twenty-eight and a half degrees, east
twenty-eight poles to a locust post ; north fifty-eight degrees,
east eighteen poles crossing the Staunton and Parkersburg
turnpike to a point near the same; thence south sixty-one
degrees, east four and a half poles to the corner of W. M.
Chews’ lot; thence north twenty-eight and a half degrees,
east fourteen poles to corner of same lot; thence south sixty-
four degrees, east fifteen and three fourths poles to a corner
of G. W. Fraley’s lot; thence north twenty-eight and a half
degrees, east twelve poles to the beginning; and that the
same be and is hereby made a town corporate, by the name
of Monterey; and by that name shall have and exercise the
owers conferred by the fifty-fourth chapter of the Code of
irginia, edition of. eighteen hundred and seventy-three, so
far as the same may be applicable to the government of
towns of less than five thousantl inhabitants, and not incon-
sistent with the provisions of this act.
2. That the officers of said town shall consist of five trus-
tees, a recorder and sergeant; that the trustees of said town
shall be J.C. Matheny, W. W. Fleming, H. M. Patterson, and
J.C. Long; that W. C. Fleming shall be recorder, and shall
be sergeant; all of whom shall remain in office until their
successors are elected or appointed and qualified; and a ma-
jority of the trustees shall constitute a board for the trans-
action of business.
3. That the annual elections of officers, provided for by
this act, shall be held in the courthouse of said county of
Highland on the last Saturday in May.
4, That so much of the pasture field of A. H. Fleisher, and
of the meadows of L. H. Stephenson as are included within
the boundaries aforesaid, shall not, until the growing wants
of the town require it, be laid off into town lots or subject
to taxation for town purposes, nor, until such time, shall
streets or alleys be opened through the same.
5. That so much of the said act of March twenty-ninth,
eighteen hundred and forty-eight, as is inconsistent with this
act, is hereby repealed.
6. This act shall be in force from its passage.
