Chap. 80.—An ACT to amend and re-enact an act to authorize the
construction, alteration, and repair of roads in the counties of Car-
roll and Grayson, approved February 13, 1877, as amended by an
act approved March 12, 1878.

1. Be it enacted by the general assembly, That the act enti-
tled an act to authorize the construction, alteration, and repair
or roads in the counties of Carroll and Grayson, approved
February thirteenth, eighteen hundred and seventy-seven, as
amended by an act entitled an act to amend and re-enact sec-
tion one of an act entitled an act to authorize the construction,
alteration, and repair of roads in the counties of Carroll and
Grayson, approved March twelve, eighteen hundred and sev-
enty-eight, be amended and re-enacted so as to read as fol-
low :
$1. Be it enacted by the general assembly of Virginia, That
it shall be lawful for the judges of the county courts of Carroll
and Grayson counties to require any surveyor of the public
road, with such hands as are in his district or allotted to him
to keep his precinct of roads in repair, to aid and assist, under
the authority and superintendence of an overseer, who may be
appointed for that purpose, to open any new road that may be
established by either of the said courts in their respective
counties, or to repair or change roads already established, or
to repair or build bridges: provided, however, that no person
required to work upon the public roads shall be compelled to
work more than four days in any one year in the construction
of any such new roads, repairs, and alterations as aforesaid,
or to travel more than five miles from his place of residence to
perform such labor; nor shall any overseer or hands be allot-
ted or required to work upon any other road than that to which
he has been once assigned by order of the court, under the
provisions of this act, until the work upon said road shall have
been complcted or abandoned. And the overseer superintend-
ing the opening of any new road, repair, change, or alteration
of any road established, or the repair or building of any bridge
or causeway by an order of either of said courts; shall, by vir-
tue of his appointment, have power, and said superintendent
is hereby authorized in case of repairing or building a bridge,
to employ skilled labor if necessary, and provide, by purchase
or otherwise, material necessary to the work; and said super-
intendent is hereby required to keep an itemized account, on
oath, which account, if approved as just and reasonable by the
county court, shall be allowed and paid out of the county levy.
2. Any failure to perform the labor hereinbefore required,
shall be subject to the same proceedings, and liable to the same
penalties as are now prescribed in the twenty-second section of
chapter one hundred and eighty-one, of the Acts of the Gene-
ral Assembly of eighteen hundred and seventy-four-five, ap-
proved twentieth of March, eighteen hundred and seventy-five ;
and such fines as may be imposed, or any money arising there-
from under this act, after the payment of a fee of fifty cents
per day for the time so employed upon the said work to the
overseer herein authorized to be appointed, and the costs, shall
be expended in the construction, repairing and alteration of
such road.
8. Each surveyor slfatl designate one or more of his hands
whose duty it shall be to summon his list cf hands to work
upon the road at such time and place as said overseer may ap-
point; and every day such hand or hands may be employed in
summoning hands, shall be deducted from the number of days
he is required to work upon the road. No surveyor shall be
entitled to compensation for his services, but shall be exempt
from serving upon petit juries.
4. All the provisions of the @eneral road law inconsistent
with this act are hereby repealed, as to the counties of Carroll
and Grayson.
