Chap. 180.—An ACT for the relief of Joseph A. Carr, of Loudoun
eounty.
Approved March 3, 187
1. Be it enacted by the general assembly. That the county
court of Loudoun county is hereby authorized and required to
hear proof of the insolvency of tax-payers, against whom
Joseph A. Carr, late deputy treasurer of the said county, held
tax-tickets for collection in the year eighteen hundred and sev-
enty-five, and shall certify to the auditor of public accounts,
as insolvent, such taxes as the said Joseph A. Carr shall prove
that he did not collect, and could not by the use of due dili-
gence have collected. Upon the receipt of the certificate of
the county court of Loudoun county as to the insolvency of
the said tax- “payers, as above required, the auditor of public
accounts shall issue his warrant in favor of the said Joseph A.
Carr, payable out of any money in the treasury not otherwise
appropriated, for the amount of the insolvents so certified.
2. ‘This act shall be in force from its passage.
CHAP. 18l.—An ACT to amend the 13th seetion of 76th chapter of
the Code of Virginia, edition of 1873, in reference to sales of pro-
perty of religions, benevolent, and literary associations.

1. Be it enacted by the gener alassembly, That the thirteenth
section of chapter seventy-six of the Code of Virginia, edition
of eighteen handred and sevent y-three, be amended and re-
enacted so as to read as follows:
615. Whenever any religious congregation, benevolent or
literary association, for w hose use a conveyance, devise or ded-
jeation of land has been lawfully mace, ¢ shall deem their interest
will be promoted by a sale of such land, or by the execution of
a inorteage or deed of trust thereon, it shall be lawful for any
inember of such congregation, benevolent or literary associa-
tion, in his name and on behalf of the other embers thereof,
to prosecute a suit in equity for eifuer of said purposes in the
cireuit conrt of the county or corporation in whicn such land,
or tue greater part therof, may lie, against the trustees or sur-
yvivors of them in whom the legal title inay be; and it shall be
lawfal for such court, if a proper case bo made, and the court
he of opinion that the rights of others will not be violated
thereby, to order the sale of such land, or the execution of such
mortgace or frust, and make such disposition of the proceeds
of such sale, mor tzage or trust as the congregation, benevolent
or literary association may require.
