Chap. 172.—An ACT to amend and re-enact the 7th section of chap-
ter 212 of the Aets of 1876-77, for the protection of fish In the
waters of the Cominonweaith above Tidewater,
Approyed March 3, 1879.
1. Be it enacted by the general assembly of Virginia, That
section seven of an act approved twenty-first of March, eigh-
teen hundred and seventy-seven, for the protection of fish in
the waters of the commonwealth above tidewater, be amended
and re-enacted so as to read as follows:
§ 7. It shall be the duty of the judge of each county or cor-
poration court to give this act in charge to every grand jury,
whose duty it shall be to present every infraction thercof not
reported and prosecuted by the sheriff; and the common-
wealth’s attorney for each county and city shall diligently
prosecute every such violation of this aet: provided, the pro-
visions of this act shall not apply to any of the waters empty-
ing info Tennessee and Kentucky, nor to such part of the
streams emptying into North Carolina as are below the Blne
Ridge, until the governor of Virginia shall by proclamation
announce that North Carolina nas by law prohibited the taking
of fish in such wa‘ers by means of traps, seines, or nets.
2. This act shall be in force from its passage.
