CHAP. 151.—An ACT to incorporate the town of Waverly, in the
eounty of Sussex,
Approved February 27, 1879.
1. Be it enacted by the general assembly, That the town of
Waverly, in the county of Sussex, as the same has been or may
be laid off into lots, streets and alleys, shall be and the same
is hereby made a town corporate, by the name of the Town of
Waverly; and by that name shall have and exercise the powers
conferred upon towns by and be subject to the provi ions of
the fifty-fourth chapter of the Code of eiehteen hundred and sev-
enty-three, and acts amendatory thereof, so far as the pro-
visions of the same are not inconsistent with the provisions of
this act.
2. The boundaries of said town shall be as follows: Begin-
ning st Lobb’s shop crossing, rupnine thence, airline, to Burt's
erossing on Atlantic, Mississippi and Ohio railroad; thenee
along county read leading to Blackwater, to a point intersected
by county road leading to Waverly; thence by air-line to cual-
vert on Atlantic, Mississipp! and Ohio railroad, where said rail-
road crosses the spring branch; thence by air-line back to
Lobb's shop crossing, before mentioned.
o. Phe officers of said town shall consist of five trustees, who
shall coimpose the council, three of whom shall constitute a
quorum to transact business, and a sergeant, who shall hold their
offices for two years, and until their successors are elected and
qualified. Phe said council shall have power to pass all by-laws
anid ordinances necessary for the propor covernment of said
town, bet im conflict with the coustitution and laws ef the state
or of the United States. and slso to provide for keeping the
streets in order and paving the samme, and for other necessary

4. The counet shall cleet from their own number 4 president,
who shell preside at all meetings of the council, and when they
are equelly divided shall, in addition to his individual vote,
vive the carting vote; and he shall be invested with all the
powers of a justice of the penee wilhit: the limits of satd town.
Aj. R.W. Arnold, VP. Fleetwood, J. S. Ellis, W. W. Coggin,
and R. W. Chappell are hereby appointed trustees of said
town, end shall have and exercise all the powers herein granted
to said oflivers, and remain in ofdece until their suecessers shall
be elected and qualified according to law.
6. The said council shall, when organized, and every two
years thereafter, appomt a sergcaut, who shall be a conserva-
tor of the peace, and be invested with the full powers of a
constable within the limits ef said town, and also have power
to arrest offenders within one mile of said limits for offences
conimitted therein. He shall collect town taxes, and have
power to distrain and sell therefor, in like manner as a county
treasurer may distrain and sell fer state taxes.
7. The said council shall have power ta impose a tax, not cx-
ceeding twenty cents on the hundred dollars, for all purposes:
provided, however, that said council may impose a further tax,
not exceeding fifty cents on the hundred dollars, when author-
ized by a two-thirds vote of all the legally qualified voters of
said town.
8. This act shall be in force from its passage.
