CHAP. 137,—An ACT enlarging the powers of the Brook turn-
pike company in constructing a branch road.
Approved January 31, 1890.
Whereas the Richmond and Henrico railroad turnpike
and graded road company, incorporated by and under the
act of assembly approved March thirty-first, eighteen hun-
dred and eighty-one, entitled “an act toincorporate the
Richmond and Henrico railroad turnpike and graded road
company,” has, under a deed of trust, and by virtue of
section twelve hundred and thirty-three of the code of
Virginia, eighteen hundred and eighty-seven, aliened and
conveyed all its works and property to the Brook turnpike
company, a corporation incorporated under the laws of
this state ; therefore,
1. Be it enacted by the general assembly of Virginia,
That the Brook turnpike company shall have authority to
construct, from a point on their road in the county of
Henrico not distant further than one mile from the north-
western termination of the street known as Lombardy
street, extended, in the cityof Richmond, a turnpike road
not less than sixty feet in width, and to construct over
Bacon Quarter branch, in the said county of Henrico,
such bridge or bridges as may be necessary for the said
road under this act; said road to be held by this said
Brooke turnpike company under the same rights and priv-
ileges and subject to the same duties as it now holds its
present property under said section of the code: provided,
that the assent of the city council of the city of Rich-
mond andof the county court of Henrico county be first
obtained thereto: and provided, further, that the road
authorized to be constructed under this act, shall not pass
over any county road or public thoroughfare now or ever
in actual use, and that the tolls on the said road so con-
structed shall be the same as those now allowed by law on
the principal road of the said company known as the
Brook turnpike. .
2. This act shall be in force from its passage.
