Chap. 6.—An ACT relating to the making out and certification
of abstracts of votes and relating to the making out and delivery
of certificates of election.
Approved December 20, 1889.
1. Be it enacted by the general assembly of Virginia,
That sections one hundred and thirty-six and one hundred
and thirty-seven of the code of Virginia of eighteen hun-
dred and eighty-seven, relating to the making out and cer-
tification of abstracts of votes and relating to the making
out and delivery of certificates of election, be amended
and re-enacted so as to read as follows:
Sec. 186. So soon as the commissioners aforesaid shall
_ determine the persons who have received the highest num-
ber of votes for any office, the clerk shall make out
abstracts of the votes in the following manner: First, for
governor and lieutenant-governor on one sheet; second,
for attorney-general on one sheet; third, for member or
members of the senate and house of delegates on one
sheet; fourth, for a representative in congress on one
sheet: fifth, for electors of president and vice-president of
the United States on one sheet ; sixth, for county officers
on one sheet; seventh, for district officers on one sheet;
eighth, for corporation officers on one sheet; which ab-
stracts being certified and signed by said commissioners
, and attested by the clerk, shall be deposited in the office
of the latter; and certified copies thereof, numbered one,
two, three, four, and five (when said officers have been
, voted for at said elections), under the official seal of said
clerk, shall be placed in separate envelopes, endorsed, and
- directed to the secretary of the commonwealth, and for-
warded immediately to the seat of government by mail;
and the said clerk shall endorse on the back of each envel-
ope in which the said certified copies are enclosed, copy of
the abstract of votes cast for governor, &c. , members of the
general assembly (as the case may be) cast at the general
election in county (or corporation ), in
. eighteen hundred and . Anyclerk willfully vio-
lating any of the provisions of this section, except those
relating to a representative in congress and to electors for
president and vice-president of the United States, shall be
punished by a fine of not less than one hundred dollars
nor more than one thousand dollars and by confinement
in jail for a period of not less than thirty days nor more
than six months.
Sec. 187. The clerk shall immediately make out, in pur-
suance of the determination of the commissioners, a cer-
tificate of election for each of the persons having the high-
est number of votes for any county, corporation or dis-
trict office, or, in case of a tie, who have been decided b
lot to be elected, and deliver the same to the person elected, ,
upon his making application therefor. Any clerk willfully
violating the provisions of this section shall be punished
by a fine of not less than one hundred dollars nor more
than one thousand dollars and by confinement in jail for a
period of not less than thirty days nor more than six
months.
2. This act shall take effect at and from its passage.
Chap. 7—An ACT to amend and re enact section 1267 of the
code of 1887, in relation to agents of insurance companies.

1. Be it enacted by the general assembly of Virginia,
That section twelve hundred and sixty-seven of the code
of eighteen hundred and eighty-seven be amended and
re-enacted so as to read as follows:
§ 1267. If any such agent shall be removed, resign, die,
become insane, or otherwise incapable of acting, it shall
be the duty of the company to appoint another agent in
his place, as prescribed by the preceding section, and until
such appointment. is made, or during the absence of any
agent of such company from the state, or if no such agent
be appointed as prescribed by the preceding section, ser-
vice of process may he upon the auditor of public accounts
with like effect as upon an agent appointed by the com-
pany. The officer serving such process upon the auditor
shall immediately transmit a copy thereof by mail to the
company, and state such fact in his return.

CHaP. 8—An ACT to amend and re-enact chapter 46 of the acts
of Assembly of 1879-'’80, approved February 4, 1880, entitled an
am for the relief of John Milliner, administrator of Robert Mil-
er.

1. Be it enacted by the general assembly of Virginia,
That chapter forty-six of the acts of assembly of eighteen
hundred and seventy-nine-eighty, approved February
fourth, eighteen hundred and eighty, entitled an act for
the relief of John Milliner, administrator of Robert Mil-
liner, deceased, be amended and _ re-enacted so as to read
as follows:
That the register of the land office be, and he is hereby,
authorized and directed to issue to the administrator of
the estate of Robert. Milliner, deceased, late an officer of
the Virginia state navy revolutionary war, and to deliver
tohim or his authorized agent, a Virginia military war-
rant for four thousand acres of land, which shall be in
lieu of the warrants issued to the heirs of said Robert
Milliner for said amount on account of his service in said
war, said warrant being issued to enable the estate of the
deceased to procure the Virginia military script due from
the United States government.

2. Upon the issue of the warrant to the administrator
the warrants heretofore issued to the heirs as aforesaid
shall be delivered up and cancelled.
3. This act shall be in force from its passage.
