An Act to amend and reenact §§ 8.01, 3.02, 8.08 and 8.09 of Chap. 211
of the Acts of Assembly of 1962, approved March 9, 1962, which pro-
vided a charter for the city of Chesapeake, relating to the composition
of, election to and filling vacancies in the city council; and the office
of mayor.

Be it enacted by the General Assembly of Virginia:
l. That §§ 3.01, 3.02, 3.03 and 3.09 of Chapter 211 of the Acts of Assem-
bly of 1962, approved March 9, 1962, be amended and reenacted as follows:
§ 3.01. Composition. * The Council shall consist of nine members
to be elected by and from the city at large, without regard to borough
residency.
§ 3.02. Election of Councilmen. * On the fourth Tuesday in April
tm ninetren hundred sixty-six there shall be a special election at which
the qualified voters of the city shall elect nine councilmen for terms of
four years beginning on the first day of September next following the
date of their election. Election and qualification of councilmen in nineteen
hundred sixty-six shall terminate the terms of all incumbent councilmen
even though they may have been elected for longer terms.
On the second Tuesday in June in nineteen hundred seventy there
shall be a general election at which the qualified voters of the city shall
elect nine councilmen; the five councilmen receiving the highest number
of rotes tn this general election shall be elected for terms of four years
and the next four councilmen receiving the next highest number of votes
shall be elected for terms of two years; all terms shall begin on the first
day of September next following the date of their election and until their
successors are duly elected and qualified.
On the second Tuesday in June in nineteen hundred seventy-two and
on the second Tuesday in June of every second year thereafter there shall
be a general election at which time the qualified voters of the city shall
elect its councilmen for the ensuing four years as their terms hereinabove
set forth expire; said terms beginning on the first day of September next
following the date of their election and until their successors are duly.

§ 3.03. Filling Vacancies. Vacancies in the office of councilmen,
from whatever cause arising, shall be filled within sixty days for the
unexpired portion of the term by * special election. If such vacancy occurs,
the Judge of the Corporation Court of the city shall issue a writ of election
to fill such vacancy. Such writ shall be directed to the sergeant of the city.
* So long as any councilmen are elected by and from boroughs the vacancy
shal] be filled by a qualified voter residing in the same borough. Prior to
holding of said election, the Judges of the Corporation Court and Circuit
Court of the city of Chesapeake shall forthwith make an interim appoint-
ment to the Council, such appointee to serve until the vacancy has been
properly filled by an election as set forth above.
§ 3.09. Mayor. At its first regular meeting of the term the council
shal] choose by majority vote of all the members thereof one of its mem-
bers to be mayor and one to be vice-mayor. * The mayor shall preside
over the meetings of the council, shall act as head of the city government
for ceremonial purposes and shall have such other rights and duties as
the council] may prescribe, in addition to all the rights and privileges of
councilmen of the city. The vice-mayor shall perform the duties of mayor
in the absence or disability of the mayor.

An Act to amend the Code of Virginia by adding in Chapter 9 of Title 28
an article numbered 8 containing sections numbered 28-91.14 through
28-91.17 and an article numbered 9 containing sections numbered
23-91.20 through 28-91.28, to continue the George Mason College of
the University of Virginia, and the Clinch Valley College of the
University of Virginia, to provide for the functions thereof, to pro-
vide for the powers of the rector and visitors of the University of
Virginia and president, respectively, in relation thereto, expenditure
of appropriation therefor, and to validate certain acts and proceed-
ings; to repeal §§ 23-91.1 through 28-91.4, relating to the same subject
matter; and to provide when certain portions of act to take effect.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding in Chapter 9 of
Title 23 an article numbered 8 containing sections numbered 23-91.14
through 23-91.17, and an article numbered 9 containing sections numbered
23-91.20 through 23-91.23, as follows:
Article 8.
George Mason College
8 28-91.14. George Mason College heretofore established in Fair-
fax County, Virginia is continued. It shall be a division of the Univer-
sity of Virginia. It shall be a four-year institution with the right to
prepare students for the granting of degrees upon graduation there-
from. In addition the college shall be authorized to offer graduate study in
various fields upon the approval of the rector and visitors, and upon such
approval of the State Council of Higher Education as may be required by
law. It shall be an integral part of the University of Virginia and be
subject to the supervision, management and control of the rector and
visitors of the University of Virginia.
8 28-91.15. All property, property rights, duties, contracts and
agreements of such division are vested in the rector and visitors of the
University of Virginia. The president of the University of Virginia, by
virtue of his office, shall be the principal administrative officer of such
division. The board of visitors of the University is charged with the
care and preservation of all property belonging to such division. With
respect to such division the board of visitors shall have the same powers
as to granting degrees, as to fixing tuitions, fees and other charges,
as to borrowing money and issuing bonds, as to the appointment and
removal of administrative officers, professors, agents and servants, and
the making of rules and regulations, as are now vested in them with
respect to the University. The title of the chief local administrative
officer of such division shall be fixed by the board of visitors.
8 23-91.16. Appropriations, directly or indirectly, from the State
to such division shall be expended as directed by the rector and visitors
of the University of Virginia.
§ 23-91.17. All acts and proceedings heretofore taken by the rec-
tor and visitors of the University of Virginia with respect to the estab-
lishment and maintenance of the George Mason College, including all

§ 23-9120. Clinch Valley College heretofore established in Wise
County, Virginia, is continued. It shall be a division of the University of
Virginia. It shall be a four-year college with the right to prepare students
for the granting of degrees upon graduation therefrom. It shall be an
integral part of the University of Virginia and be subject to the super-
vision, management and control of the rector and visitors of the University
of Virginia.
§ 28-91.21. Al property, property rights, duties, contracts and agree-
ments of such division are vested in the rector and visitors of the Univer-
sity of Virginia. The president of the University of Virginia, by virtue
of his office, shall be the principal administrative officer of such division.
The board of visitors of the University is charged with the care and preser-

division the board of visitors shall have the same powers as to granting

§ 23-91.22. Appropriations, directly or indirectly, from the State to
such division shall be expended as directed by the rector and visitors of
the University of Virginia.
§ 23-91.28. All acts and proceedings heretofore taken by the rector
and visitors of the University of Virginia with respect to the establish-
ment and maintenance of the Clinch Valley College, including all contracts,
loan agreements and other agreements of whatsoever nature, are hereby
ratified, validated and confirmed.
2. §§ 23-91.1 through 23-91.4 of the Code of Virginia are repealed.
3. The provisions of this act insofar as they affect Clinch Valley College
shall be in force and effect on and after September one, nineteen hundred
sixty-eight.
