CHAPTER 481
An Act to amend the Code of Virginia by adding a section numbered
15.1-495.1, relating to persons who may make application for variances,
special exceptions or rezoning.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section numbered
15.1-495.1, as follows:
§ 15.1-495.1. Notwithstanding the provisions of this Chapter, the
governing body of any county having a population of more than twenty-
seven thousand three hundred but less than twenty-seven thousand six
hundred may, by ordinance provide that no person shall make application
for variance, special exception or rezoning unless he is the owner or con-
tract purchaser, or the duly authorized agent or attorney of such owner or
contract purchaser, of the property subject to such variance, special excep-
tion or rezoning, or unless he file with his application the written consent
of such owner or contract purchaser.
No provision of this section shall be construed to affect the power
or authority of the governing body of any county, city or town, on its own
motion, to rezone properties within its jurisdiction or to obtain variances
or special exceptions with regard thereto.
The provisions of this section shall not affect any application of a
public service corporation for approval of public service facilities under
section 15.1-456 or 15.1-495 (a).
