An Act to amend and reenact § 15.1-876.1 of the Code of Virginia, relat-
ig to sale or lease of airspace over certain cities and counties.

Be it enacted by the General Assembly of Virginia:
re, 15.1-376.1 of the Code of Virginia be amended and reenacted
§ 151876.1. The governing body of any city having a population
‘More than * ninety thousand or any county having a density of popula-
Mn excess of four thousand inhabitants per square mile may, by ordi-
rize the sale or lease of the airspace over any public street,
highway, lane or alley in such city or county; provided, however, that r
building, structure or appurtenance thereto, constructed over any suc
street, highway, lane or alley shall have less than a minimum clearan
of sixteen feet and providing further that nothing herein shall be co
strued to relieve any such grantee or lessee of such airspace of the liabilit
for negligence on their part. No such ordinance shall be adopted by ar
city or county until the governing body has held a public hearing therec
after public notice as provided in § 15.1-431 and has obtained, in writin:
the consent of the State Highway Commissioner.
Should the construction of any building or structure in any suc
airspace require the relocation of any overhead utility, the cost of suc
relocation shall be borne by the grantee or lessee.
2. An emergency exists and this act is in force from its passage.
